OFFICIAL RULES
One Roof Foundation (“One Roof”) and Metro Parks Tacoma (“MPT”) invite fans and locals to participate in the “Power Play” Youth Art Contest. Participants will enter for a chance to have their original artwork featured on the Verlo Playfield sport court fence panels and to win a $500 personal gift card and tickets to a Seattle Kraken game (estimated total retail value is $800 USD), subject to these Official Rules (the “Contest”).
CONTEST ADMINISTRATOR AND SPONSOR
The Contest is proudly administered by One Roof, located at 10601 5th Ave NE, Seattle, WA 98125, and sponsored by MPT.
WHEN IS THIS HAPPENING?
The Contest commences on April 1, 2024 at 12:01am PST and ends May 19, 2024 at 11:59pm PST (the “Promo Period”). Any entry submitted after 11:59pm PST on May 19, 2024 is void.
HOW TO ENTER
By entering the Contest, participants and their parent(s)/legal guardian(s) agree to these Official Rules. Participants must be between ages three (3) and eighteen (18) years old on the date of entry into the Contest. Parent or legal guardian consent is required to enter. Participants must be legal residents of the United States and reside or attend programs in the general east Tacoma, WA neighborhood, as determined by MPT.
To enter, eligible participants must create original artwork in response to the following statement:
Create an empowering image showcasing the connection between play and heart health, inspiring individuals to embrace an active lifestyle while enjoying the fun of street hockey.
Such participants and their parent(s)/legal guardian(s) must then complete an entry form and submit the artwork using the link located at https://tacomaarts.submittable.com/submit/d48efb34-1869-4cda-97d0-f40350df46d4/mpt-verlo-sport-court-art-contest or physically submit the artwork and completed form at designated Park District locations. Participants must provide all requested information to enter; incomplete or inaccurate entries will not be eligible to win. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. Limit one (1) entry per individual. Artwork must not contain obscenity, profanity, commercial solicitation or commercial promotion. Submissions must conform to local law, must not contain content or images that could be considered abusive, inflammatory, denigrating, or disrespectful to any groups, individuals or institutions and must be suitable for a public audience. One Roof and/or MPT reserve the right to disqualify, at their sole and absolute discretion, any entry that does not adhere to these criteria. The artwork may be in any medium (e.g., pen, paint, crayons, illustrations, mixed-media) and should be approximately the size of a standard sheet of printer paper (8.5” x 11”). Acceptable file types for submitting the artwork include .csv, .doc, .docx, .odt, .pdf, .rtf, .txt, .wpd, .wpf, .gif, .jpg, .jpeg, .png, .svg, .tif and .tiff. If the artwork is smaller than 8.5” x 11” when printed, it may not be high enough resolution to be usable on the sport court panel.
By participating in the Contest and/or claiming a Prize (as defined below) should you be selected as a Winner, participants and their parent(s)/legal guardian(s) certify that (i) participant is between the ages of three (3) and eighteen (18) years old on the date of entry into the Contest, (ii) participant’s parents(s)/legal guardian(s) consent to participant’s entry into the Contest, (iii) participant is a legal resident of the United States and resides or attends programs in the east Tacoma, WA neighborhood, as determined by MPT, (iv) participant’s parents(s)/legal guardian(s) will accept the gift card and ticket portion of the Prize on participant’s behalf, and (v) they agree to these Official Rules and One Roof’s Terms of Use and Privacy Policy. Eligibility for the Contest is contingent upon these certifications. No purchase or payment is necessary to enter or win; void where prohibited. Employees, directors, officers, and agents of One Roof, MPT, Seattle Hockey Partners LLC (“SHP”) or Seattle Arena Company, LLC (“SAC”) and each of their respective parent companies, divisions, dealers, affiliates, subsidiaries, advertising and promotional agencies, partners and suppliers involved in the Contest (collectively, the “Contest Parties”), as well as the members of each of their immediate families (spouse, parents, children, siblings, and in-laws) and persons residing in the same household as such individuals are not eligible to enter or win.
PRIZE
Nine (9) total winners (each, a “Winner” and collectively, the “Winners”) will be selected to have their artwork featured on the Verlo Playfield sport court fence panels, and each Winner will be awarded a $500 personal gift card and two (2) tickets to a Seattle Kraken home game during the 2024-25 NHL season (collectively, a “Prize”). Three (3) Winners will be selected from the three (3) to seven (7) year old age group, three (3) Winners will be selected from the eight (8) to twelve (12) year old age group and three (3) Winners will be selected from the thirteen (13) to eighteen (18) year old age group. The date, location of the Seattle Kraken tickets and other Prize details are at One Roof’s sole discretion. You must have a Ticketmaster.com account in order to accept ticket portion of the Prize. Limit one (1) Prize per Winner. All other costs and expenses related to a Prize are not covered.
The Winners may not substitute a cash award in lieu of a Prize and the Prizes may not be substituted for one another. The Winners are solely responsible for paying any applicable local, state, or federal taxes related to the Contest, as well as any costs and expenses associated with any Prize. For tax purposes, Winners and/or their parent(s)/legal guardian(s) may be required to provide One Roof and/or SHP with their social security number as a prior condition to participating in or accepting a Prize. One Roof makes no warranty or guarantee regarding any Prize, express or implied, and the Prizes are awarded on an “as-is” basis. By participating in the Contest and accepting any Prize, each participant agrees to abide by all applicable laws as well as all policies in force at One Roof, SHP, SAC, and/or Climate Pledge Arena, as applicable. One Roof reserves the right to substitute any Prize for a prize of equal or greater value if the original Prize cannot be honored for any reason. One Roof further reserves the right, in its sole discretion, to refuse to honor any Prize if too few entries are received or if the participant or their guest claiming it is unruly, disruptive, uncooperative, fails to comply with any policies of One Roof, SHP, SAC and/or Climate Pledge Arena, or may or does cause damage to any person, property, or the reputation of One Roof, SHP, SAC and/or Climate Pledge Arena. The Prizes, including any additional restrictions, are at One Roof’s sole discretion.
HOW TO WIN
After the Promo Period ends, a panel of reviewers including representatives from MPT and One Roof will select three (3) Winners from each eligible age group (nine (9) total Winners). The potential Winners will be notified by e-mail or phone based on the contact information provided in the entry form by no later than 9:00pm PST on May 31, 2024. Participants do not need to be present to win; however, the potential Winners and/or their parent(s)/legal guardian(s) must respond to the notice from One Roof in writing to accept and claim their Prize by no later than fourteen (14) days after One Roof sends the notice (the “Response Deadline”). If One Roof does not receive written confirmation that a Winner accepts their Prize by the Response Deadline, such Winner forfeits any right to or claim on a Prize, and One Roof may, at its sole discretion, select another Winner in the same manner described above. Each Winner must provide an e-mail address for where the ticket portion of the Prize will be transferred. By claiming or accepting any Prize, each Winner and their parent(s)/legal guardian(s) certify that they agree to the terms and conditions set forth in these Official Rules.
Any Prize that is obtained in contravention of these Official Rules or the local, state, or federal law will be deemed void and will not be honored. The Prizes may not be sold or transferred. One Roof will determine in its sole discretion whether any Prize has been improperly obtained, presented, or transferred.
REPRESENTATIONS AND INDEMNIFICATION
Each and every participant, Winner and their parent(s)/legal guardian(s) hereby represents and warrants that they have read these Official Rules, are fully familiar with their contents, and agree to abide thereby. Each participant and their parent(s)/legal guardian(s) hereby further represent that the submitted artwork is an original work of authorship and sole creation of participant, and will not infringe on any third-party rights, including copyright, trademark, patent, right of publicity, personal, or property rights. Each Winner and their parent(s)/legal guardian(s) shall be responsible and liable for their actions and the actions of any guest who partakes in the Prize, including any third party to whom a Prize is gifted, sold or transferred. Each participant further agrees to indemnify, defend, discharge, release, forever acquit, and hold the Contest Parties harmless against any and all demands, claims, actions, or proceedings of any kind, and from any and all injuries, damages, liabilities, costs, and expenses related to or arising out of the participation in the Contest, any Prize awarded (including resulting from the Winner and any guest’s participation or use thereof), or any breach or alleged breach of any of the warranties, representations, or agreements of participants hereto. Each Winner and any Guest who participates in a Prize in any way may be required by a Contest Party to execute additional forms, releases, and/or waivers as a prior condition to participating in or accepting a Prize.
RELEASE OF LIABILITY
Participants and their parent(s)/legal guardian(s) agree to obey all applicable laws and regulations, including any local guidance or mandates related to any pandemic at the time of the any event related to the Contest or the Prizes, and to be bound by these Official Rules. By participating in the Contest, each participant and their parent(s)/legal guardian(s) fully and unconditionally release the Contest Parties from (1) all claims for liability arising from or related to participation in the Contest and (2) all claims related to a participant’s acceptance, receipt, possession, loss, and/or misuse of any entry or any Prize. One Roof, SHP and SAC make no representations regarding the effects, condition, safety or potential exposure risks related to COVID-19, any pandemic-related precautions that are required or not required by One Roof, SHP or SAC, or attendance at the performance.
In the event One Roof is unable to continue the Contest or to honor any Prize due to any event beyond its control, including but not limited to technological errors, fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil unrest, terrorist threat or act, war (declared or undeclared), or any local, state, or federal law, order, or regulation, then subject to any governmental approval that may be required, One Roof reserves the right to modify, suspend, extend, or terminate the Contest and these Official Rules.
GRANT OF LICENSE; USE OF NAME AND LIKENESS
By entering the Contest, each Winner and their parent(s)/legal guardian(s) hereby grants the Contest Parties and their third-party transferees and sublicensees (in such Contest Party’s sole discretion) a non-exclusive, perpetual, worldwide, irrevocable, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, publish, depict and/or display the submitted artwork in all forms and in all media and in all manners by any method or device now known or hereafter devised for any lawful purpose. The Contest Parties and their third-party transferees and sublicensees may modify, alter, adapt and/or edit the submitted artwork for the purposes described in these Official Rules.
By entering the Contest, each Winner and their parent(s)/legal guardian(s) grant the Contest Parties and their third-party transferees and sublicensees (in such Contest Party’s sole discretion), a perpetual, non-exclusive, royalty-free, worldwide, irrevocable license to use, sublicense, distribute, reproduce, publish, and/or depict your likeness, along with your name (or fictional names or social media handles, as applicable) (your “Likeness”) in connection with the Contest, in all forms and in all media and in all manners by any method or device now known or hereafter devised for any lawful purpose.
Each participant and their parent(s)/legal guardian(s) acknowledge that they have received good and valuable consideration for these grants and participation in the Contest and waive all right of inspection or approval or claim to damages or further compensation with respect to these unqualified grants.
DATA PRIVACY
Private or personally identifying information collected in connection with the Contest may be retained by One Roof, SHP and SAC, sold, shared with business partners and/or affiliates, and/or used for marketing purposes. By participating in the Contest, you consent to One Roof, SHP and SAC’s collection and use of your personal information as described in our privacy policy available here: https://www.nhl.com/kraken/info/privacy.
DISPUTES
The Contest and these Official Rules are governed by the laws of the United States and the State of Washington. As a condition of participating in the Contest, participants and their parent(s)/legal guardian(s) agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with the Contest, shall be resolved individually, without resort to any form of class action, by final and binding arbitration administered by JAMS and conducted in Seattle, Washington before a sole arbitrator in accordance with the rules of JAMS.
