Open House Select-a-Seat Contest
Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE OPEN HOUSE SELECT-A-SEAT CONTEST (“Contest”).
By entering into the Contest, each contestant unconditionally accepts and agrees to comply with and abide by these official rules (“Official Rules”) and the decisions of Anaheim Ducks Hockey Club, LLC (“Sponsor”) which shall be final and binding in all matters relating to this Contest. This Contest is not sponsored, endorsed or administered by, or associated with, Facebook.
The Contest will begin at 9:00 a.m. PT on May 4, 2025, and will end at 5:00 p.m. PT on May 4, 2025 (“Contest Period”).
1. Eligibility. To be eligible to compete in the Contest, entries must be received by Sponsor by the conclusion of the Contest Period and must meet these eligibility requirements. Limit one entry per person/e-mail account. Any attempt by any person to submit more than one entry will void all of that person's entries and that person will be disqualified. All contestants must be at least eighteen (18) years of age, legal residents of the State of California and able to provide a valid California-issued identification. Unclaimed prizes shall remain the property of Sponsor. Sponsor, Anaheim Ducks Hockey Club, LLC, their respective officers, employees, directors and subsidiaries (collectively, “Sponsor Entities”) are not eligible. Contestants must have the legal right and any and all permissions necessary to submit the Entry Materials, including all permissions of all persons included in the submitted photo, for themselves and by participating in the Contest, each contestant agrees that he/she has all rights necessary to enter and participate in this Contest and grant to Sponsor the rights described in these Official Rules. If a contestant is unable to participate in the Contest as requested by the Sponsor, Sponsor reserves the right to deem that contestant’s entry forfeited in its entirety and that contestant will be disqualified. The Contest is subject to all applicable federal, state, and local laws, rules, and regulations.
2. How to Enter. Enter the Contest by maintaining the eligibility requirements as described in Paragraph 1, and through one of four ways: (1) attend the Anaheim Ducks Select-a-Seat Open House at Honda Center on May 4, 2025 (“SAS Open House”) (“Tier 1”), (2) attend the SAS Open House and put down a Flex Plan deposit (“Tier 2”), (3) attend the SAS Open House and purchase Terrace level season tickets, (“Tier 3”) or (4) attend the SAS Open House and purchase Plaza or Club level season tickets (“Tier 4”).
All entries must be complete and received by the conclusion of the Contest Period. Odds of winning a select prize described in these Official Rules depend on the entry method and the number of eligible entries received by the conclusion of the Contest Period. Sponsor is not responsible for late or misdirected entries, or for electronic, network, computer, hardware or software malfunctions, failures or difficulties. Entries must be developed in good taste, and shall not contain content that is obscene or indecent, and shall not include profanity, drugs, alcohol, phone numbers, offensive or derogatory statements that may be offensive to individuals of a specific race, religion, ethnicity, sexual orientation or socioeconomic group, or other content deemed inappropriate by Sponsor. In the event any entry is deemed inappropriate by Sponsor, that entry will be deemed ineligible. In the event of a dispute regarding prize claims or entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry used to enter will be deemed to be the contestant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
3. Sponsor’s Use of Entries and Related Materials. By submitting an entry, each contestant agrees to and irrevocably assigns and transfers to Sponsor any and all right, title and interest that the contestant has or may have in all entry materials and all other related materials provided to Sponsor or otherwise prepared in connection with the Contest (collectively, “Entry Materials”) in any way, which may or may not include the contestant’s name, voice, image, photograph, likeness, city and state of residence. The Entry Materials will not be returned to any contestant and Sponsor has no obligation to provide contestant with copies of Entry Materials. Each contestant acknowledges and agrees that Sponsor shall have the right, but not the obligation, to use, modify, reproduce, publish, perform, display, distribute, make derivative works of, trademark or otherwise register, and otherwise commercially and non-commercially exploit the Entry Materials, including without limitation the Photo, in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate compensation to any contestant or any other person or entity or prior approval by contestant or any other person or entity. Each contestant agrees to take, at Sponsor’s expense, any further action (including without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor’s rights as set forth in this Paragraph 3.
4. Winner Selection. Contestant will not be provided an opportunity to practice, warm-up, or take qualifying shots. Contestants will be eligible for select prizes depending on their entry method: Tier 1, Tier 2, Tier 3, or Tier 4, as described in these Official Rules. Each Tier has a designated number of Targets (as defined in Section 6 below).
Tier 1 contestants will have one (1) opportunity to compete at Target #1.
Tier 2 contestants will have two (2) opportunities to compete at either Target #1 and/or #2.
Tier 3 contestants will have three (3) opportunities to compete at either Targets #1, #2, and/or #3.
Tier 4 contestants will have four (4) opportunities to compete at either Targets #1, #2, and/or #3.
One (1) pin will be placed at each Target, and each Target will be located on a designated portion of the ice rink at Honda Center. Each contestant will be provided with a hockey stick and a regulation hockey puck to shoot the puck within the confines of the Target, with the ultimate goal of shooting the puck as closest to the pin as possible. A successful shot will be determined by a representative of Sponsor. The contestant with the puck closest to the pin on the Target will be determined the winner. One (1) winner will be selected at each Target. For contestants who have opportunities to compete at multiple Targets, winning at one (1) Target will not disqualify the contestant from winning at another Target. In the case of a tie, Sponsor will notify such contestants and, in its sole discretion, either (i) coordinate a rematch round (“Rematch”) (the format, location, and time of the Rematch shall be in Sponsor’s sole discretion) or (ii) designate multiple winners.
5. Winner Notification. All potential winners will be notified by Sponsor by e-mail and phone call to the account and phone number used to enter the Contest. Sponsor will make two (2) attempts to contact each potential winner by the method described above within one (1) day of the potential winner’s name being drawn. If the Prize is not claimed within the same day of Sponsor’s final attempt to contact the winner or Sponsor is unable to reach a potential winner by the method described above within such time, Sponsor may, in its sole discretion, disqualify that winner and an alternate potential winner’s entry will be drawn from all remaining eligible entries. If notification is by telephone, Sponsor is not required to leave a message for a potential winner on an answering machine or voicemail. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason.
6. Prize. The following prizes (each, a “Prize”) will be awarded to winner(s) at each designated location (“Target”), and Contestants will be eligible to win the Prize at more than one Target:
Target #1: One (1) jersey autographed by an Anaheim Ducks team player (player and jersey type selected in Sponsor’s sole discretion). (Approximate retail value: $250.00).
Target #2: Two (2) admission tickets to the Anaheim Ducks Home Opener game at Honda Center for the 2025-2026 season (game date and seat location to be determined in Sponsor’s sole discretion), and one (1) $100 gift card for the Anaheim Ducks Team Store. (Approximate retail value: $250.00).
Target #3: Two (2) terrace-level season tickets for the 2025-2026 Anaheim Ducks regular season (seat location to be determined in Sponsor’s sole discretion). (Approximate retail value: $2,200.00).
7. Limitation of Liability; No Warranties and Release. By entering into this Contest, you accept and agree that (a) Sponsor Entities and their respective affiliates, officers, directors, employees and agents do not have and will not have any liability whatsoever for, and shall be held harmless against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Contest or any Contest related activity; or for any typographical or other error in the printing, offering or announcement of any prize; (b) the prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.); (c) Sponsor and its affiliates, officers, directors, employees and agents will have no liability whatsoever for entries that are late, incomplete or not received for any reason; and (d) except where legally prohibited, winners grant (and agree to confirm the grant in writing) permission for Sponsor, its companies, advertising and promotion agencies and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation. By participating in the Contest, you expressly waive and relinquish all rights and benefits afforded by California Civil Code Section 1542 and do so understanding and acknowledging the significance of this specific waiver of Section 1542. Section 1542 states as follows:
“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.
8. Disqualification and Cancellation of Contest and Events. At any time during the Contest, Sponsor reserves the right in its sole discretion to disqualify and eliminate any entry, Entry Materials or other submission from a contestant for any reason, including but not limited to, because Sponsor believes the entry or Entry Materials do not comply with these Official Rules. In the event that a Contest Winner is disqualified after the Contest, an alternate Contest winner will be selected from among the remaining eligible entries, if practicable. Sponsor reserves the right to amend these Official Rules, or terminate, suspend or modify the Contest, in its sole discretion, for any reason. The dates and times set forth in these Official Rules are subject to change in Sponsor’s sole discretion and in the event of any such change, Sponsor will notify the contestants by posting the change on the Website. Sponsor is not responsible for any postponement or cancellation, for any reason, of any event, exhibit or attraction forming part of the prize(s).
9. Cash Value and Taxes. Contest Winners are solely responsible for any and all expenses, and applicable federal, state and local taxes associated with claiming or using the prize. If applicable, all Contest Winners should expect to receive a tax form 1099 for the value of the Prize as provided by current tax laws. Unless otherwise specified herein, no Prize can be redeemed for cash or replaced if lost or stolen. Sponsor Entities reserve the right to replace and/or substitute a like prize of equal value, should the Prize specified in these Official Rules, or any portion thereof be unavailable, for any reason.
10. Personal Information. Sponsor may use contestant’s contact details and other information from contestant’s Sweepstakes entry, or any waiver or affidavit completed in connection with the Sweepstakes, to contact contestant regarding the Sweepstakes or to provide contestant relevant information about promotions or marketing materials. 11. Claiming the Prize. Sponsor may require Winner to claim the Prize in person at Sponsor’s business office at the address noted below or any other addressed as designated by Sponsor or may ship the prize. Sponsor Entities shall have no liability for non-delivery, and are not responsible for any mishandling by the U.S. Mail or any other delivery service the Prize. Winner may also be required to execute a “Consent, Indemnification, Waiver and Release Agreement” and/or an Affidavit of Eligibility and to provide legal and valid photo identification. In some cases, as a convenience to the winners, Sponsor Entities may elect to mail the prize, the Liability/Publicity Release and the Affidavit of Eligibility, if applicable, to the address provided on the entry. Sponsor Entities shall have no liability for non-delivery and are not responsible for any mishandling by the U.S. Mail or any other delivery service of any of the prizes.
12. Void Where Prohibited. This Contest is void where prohibited or where restricted beyond the restrictions set forth in these Official Rules, by law. Sponsor does not warrant that the Contest is valid in any particular state or jurisdiction. All applicable federal, state and local laws and regulations shall apply.
13. Winners List. Sponsor will maintain all records relating to the Contest as required by law. For a list of Contest winners, send a self-addressed, stamped envelope with your written request to the address below to the attention of Ticket Sales & Services Department: Open House Select-a-Seat Contest within six (6) weeks after the Contest.
14. Governing Law and Jurisdiction. ALL ISSUES CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND/OR ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF CONTESTANTS, SPONSOR(S) AND/OR SPONSOR ENTITIES IN CONNECTION WITH THE CONTEST (COLLECTIVELY, “CONTEST CLAIMS”) SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA WITHOUT GIVING ANY EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS. ENTRY INTO THE CONTEST GIVES EACH CONTESTANT’S CONSENT TO THE SOLE JURISDICTION OF THE SUPERIOR COURTS OF ORANGE COUNTY, STATE OF CALIFORNIA. All CONTEST Claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
