HONDA PROLOGUE FAN APPRECIATION NIGHT CAR GIVEAWAY SWEEPSTAKES

Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE HONDA PROLOGUE FAN APPRECIATION NIGHT CAR GIVEAWAY SWEEPSTAKES (“Sweepstakes”).

By entering into the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these official rules (“Official Rules”) and the decisions of Anaheim Ducks Hockey Club, LLC (“Sponsor”) which shall be final and binding in all matters relating to these Sweepstakes. This Sweepstakes is not sponsored, endorsed or administered by, or associated with, Facebook or Instagram.

Sweepstakes begins at 12:01 am PT on January 21, 2025, and ends at 11:59 p.m. PT on April 9, 2025 (“Sweepstakes Period”).

1. Eligibility. To be eligible to win, entries must be received by Sponsor during the Sweepstakes Period and must meet these eligibility requirements. Only one (1) entry per person/e-mail address/mobile phone number regardless of method of entry. Any attempt to submit more than one (1) entry per person or e-mail address or mobile phone number may result in disqualification. All winners must be at least eighteen (18) years of age and legally reside in California at the time of entering. At any time during the Sweepstakes, Sponsor reserves the right in its sole discretion to disqualify and eliminate any entry or other submission from an entrant for any reason, including but not limited to, because Sponsor believes the entry does not comply with these Official Rules. In the event that the Grand Prize winner is disqualified after the Sweepstakes, an alternate Grand Prizewinner will be selected from among the remaining eligible Finalists, if practicable, or Sponsor may award the prize as it deems fair and appropriate. Unclaimed prizes shall remain the property of Sponsor. Sponsor, Anaheim Arena Management, LLC, Honda Motor Co., Ltd., and their respective officers, employees, directors, affiliates, retailers, subsidiaries, advertising and promotion agencies, sponsors, dealers (collectively, “Sponsor Entities”) and the immediate families (spouse, and parents, children, siblings and their respective spouses, regardless of where they reside) and household members of each, whether or not related, are not eligible. If a Finalist (as defined below) is unable to participate in the event during the dates designated by the Sponsor, Sponsor reserves the right to deem that prize forfeited in its entirety. The Sweepstakes is subject to all applicable federal, state, and local laws, rules, and regulations.

2. How to Enter. Enter the Sweepstakes one of two ways: (1) go to www.anaheimducks.com/HondaPrologue, complete the form and submit the form as directed (NO PURCHASE NECESSARY); (2) use a smart phone or other web-enabled device with data plan to scan the Sweepstakes quick response (“QR”) code featured on signs or promotional materials with the QR read application already installed on the applicable device; or (3) send a text message containing "HONDA" to 81883 from your 2-way capable wireless phone (standard text messaging rates for each text message sent or received apply. A bounce-back text message will be sent to the phone number from which the text message entry originated to confirm entry. Text messaging and wireless services are not available in all areas).

The entry will be deemed received when the entry is received by Sponsor. Entries must meet the eligibility requirements of these Official Rules and must be received by Sponsor by the conclusion of the Sweepstakes Period. Odds of winning the prizes described in these Official Rules depend on the number of eligible entries received during the Sweepstakes Period. Entries must be completed in good taste and shall not contain content that is obscene or indecent, and shall not include profanity or pornography, drugs, alcohol, phone numbers, offensive or derogatory statements or gestures that may be offensive to individuals of a specific race, gender, religion, ethnicity, sexual orientation or socioeconomic group, or other content deemed inappropriate by Sponsor. In the event any entry is deemed inappropriate by Sponsor, that entry will be deemed ineligible.

3. Finalist Selection.  On or about April 10, 2025, four (4) finalists (collectively, the “Finalists”) will be randomly selected from all eligible and complete entries received by Sponsor by the conclusion of the Sweepstakes Period. The decisions of Sponsor are final and binding on all matters relating to this Sweepstakes. In the event of a dispute regarding prize claims or entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry used to enter will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the account, as applicable.

4. Finalist Notification. On or about April 10, 2025, all potential Finalists will be notified by Sponsor by the telephone number provided as part of the entry.  Sponsor will make two (2) attempts to contact each potential Finalist by the method described above within one (1) day.  If a Finalist does not respond to the notification within four (4) hours of Sponsor’s last attempt to contact the Finalist or Sponsor is unable to reach a potential Finalist by the method described above within such time, Sponsor may, in its sole discretion, disqualify that Finalist and an alternate potential Finalist’s entry will be drawn from all remaining eligible entries.  If notification is by telephone, Sponsor is not required to leave a message for a potential winner on an answering machine or voicemail. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential Finalist for any reason. If a potential Finalist cannot attend the game on Fan Appreciation Night (as defined below) or is not in compliance with these Official Rules, they will be disqualified and Sponsor may, at its discretion, select an alternate Finalist from all remaining eligible entries received, time permitting.

5. Grand Prize Winner Selection. Each of the Finalists will be required to attend the Anaheim Ducks home game scheduled to be held on April 12, 2025 (“Fan Appreciation Night”). During the second intermission of the Fan Appreciation Night, each of the Finalists will be invited backstage and later to the ice. While backstage, each Finalist will randomly select or be randomly assigned a number, position or order number. One (1) potential grand prize winner (“Grand Prize Winner”) will be announced from the four (4) Finalists during an on-ice promotion wherein each Finalist will participate in the random selection of the Grand Prize Winner using the randomly selected or assigned number, position or order number obtained backstage. The decisions of Sponsor are final and binding on all matters relating to this Sweepstakes. Odds of winning the Grand Prize is 1 in 4. If any Finalist fails to comply with any venue or other rules provided by Sponsor, they may be disqualified, at Sponsor’s sole discretion.

6. Prizes.

Grand Prize. The Grand Prize Winner will win one (1) All-Electric 2025 Honda Prologue 2WD 5D Touring SUV (“Vehicle”) (Approximate retail value (“ARV”): $55,000-$60,000; actual value dependent on vehicle awarded.”). The ARV excludes taxes, license, registration, destination charges, upgrades and accessories, which will be the responsibility of the Grand Prize winner (if applicable). The Vehicle will be delivered to an authorized Honda dealership (the “Authorized Honda Dealership”) located near the Grand Prize winner’s residence as determined by the Sponsor in its sole discretion. The Grand Prize winner will be responsible for pick-up of the Vehicle at the Authorized Honda Dealership. Taxes are not included in the Grand Prize and are the Grand Prize winner’s responsibility. Grand Prize will be available with standard equipment, as designated by Sponsor, any upgrades and accessory options are at the sole expense of the Grand Prize winner and must be arranged by Grand Prize winner after taking possession of the Vehicle. Color, package, factory options, and other prize specifics to be determined by Sponsor in its sole discretion and are subject to availability. Vehicle will be provided with the standard limited warranty. Grand Prize winner shall bear all risk of loss or damage to the Vehicle after it has been delivered to the specified delivery site. Grand Prize will be awarded within approximately 90 days after the Grand Prize winner is verified. Grand Prize winner must have proof of valid U.S. driver’s license and proof of insurance to take delivery of Grand Prize. The difference between the approximate retail value and the actual value of the Grand Prize will not be awarded.

Finalist Prizes. Each Finalist will receive two (2) admission tickets to attend the Fan Appreciation Night scheduled to be held at Honda Center on April 12, 2025, and one (1) Ducks Jersey (not game worn). (ARV: $500.00 each). Travel to/from the Honda Center is not included as part of the prize. Terms and conditions apply to use of tickets. Seat locations will be determined by Sponsor. In the event the game is cancelled or postponed, the terms of the tickets shall govern.

Total ARV of all prizes: $56,500-$61,500; actual value dependent on vehicle awarded.

7. Limitation of Liability/Publicity Grant; No Warranties and Release. By entering into this Sweepstakes, you accept and agree that (a) Sponsor Entities, Meta Platform (dba Facebook and Instagram) and their respective parents, affiliates, subsidiaries, dealerships, and all of their respective officers, directors, employees and agents (collectively, “Released Parties”) do not have and will not have any liability whatsoever for, and shall be held harmless against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize (including any use of the Vehicle) or participation in this Sweepstakes or any Sweepstakes related activity (including any travel or activity related thereto); or for any error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or for errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the Finalists, Grand Prize winner or prizes, or in any Sweepstakes-related materials; (b) the prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.); (c) Released Parties will have no liability whatsoever for entries, phone calls, or communications of any kind that are late, incomplete, garbled, stolen, misdirected, delayed, or not received for any reason; and (d) except where legally prohibited, Finalists and the Grand Prize winner grant (and agree to confirm the grant in writing) permission for Sponsor, its companies, advertising and promotion agencies and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes in any and all media, now or hereafter devised, worldwide in perpetuity, without additional compensation, notification, or permission.

By participating in the Sweepstakes, you expressly waive and relinquish all rights and benefits afforded by California Civil Code Section 1542 and do so understanding and acknowledging the significance of this specific waiver of Section 1542. Section 1542 states as follows:

“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

8. Cancellation of Events. Sweepstakes Entities are not responsible for any postponement or cancellation, for any reason, of any event, exhibit or attraction forming part of the prize(s).

9. Personal Information. Sponsor may use entrant’s contact details and other information from entrant’s Sweepstakes’ entry, or any waiver or affidavit completed in connection with the Sweepstakes, to contact entrant regarding the Sweepstakes or to provide entrant relevant information about promotions or marketing materials. 10. Prize Conditions, Restrictions, and Taxes. Winners are solely responsible for any and all expenses, and applicable federal, state and local taxes associated with acceptance and use of the prize. If applicable, all winners should expect to receive a tax form 1099 for the value of the prize as provided by current tax laws. Unless otherwise specified herein, no prize can be redeemed for cash, substituted or transferred by winners. Prizes will not be replaced if lost or stolen. Sponsor Entities reserve the right to replace and/or substitute a prize of comparable or greater value, should the specified prize, or any portion thereof be unavailable, for any reason. All prize details are at Sponsor’s sole discretion.

11. Amendment of Rules and Termination of Sweepstakes. Sponsor reserves the right to amend these Official Rules, or terminate, suspend or modify the Sweepstakes, at its sole discretion. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select Finalists and/or the Grand Prize winner (as applicable) in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination or as otherwise deemed fair and appropriate by Sponsor. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.

12. Claiming the Prize. Sponsor may require a Finalist or the Grand Prize winner to claim a prize in person at Sponsor’s business office at the address noted below or any other addressed as designated by Sponsor. Any costs or expenses associated with claiming the prize at the above-described location are the sole responsibility of the Finalist or winner. Sponsor Entities shall have no liability for non-delivery, and are not responsible for any mishandling by the U.S. Mail or any other delivery service the prize. Potential Finalists and Grand Prize winner may also be required to execute a “Consent, Indemnification, Waiver and Release Agreement” and/or an Affidavit of Eligibility, Waiver and Release and to provide legal and valid photo identification within a time period to be specified by Sponsor or prize will be forfeited. In such an event, Sponsor may, at its discretion, select an alternate Finalist or Grand Prize winner (as applicable) from all remaining eligible entries received, time permitting.

13. Void Where Prohibited. This Sweepstakes is void outside California and where prohibited or where restricted beyond the restrictions set forth in these Official Rules, by law. Sponsor does not warrant that the Sweepstakes is valid in any particular state or jurisdiction. All applicable federal, state and local laws and regulations shall apply.

14. Winners List. Sponsor will maintain all records relating to the Sweepstakes as required by law. For a list of winners, send a self-addressed, stamped envelope with your written request to the address below to the attention of Marketing: HONDA Prologue Fan Appreciation Night Car Giveaway within six (6) weeks after the end of the Sweepstakes Period.

15. Governing Law and Jurisdiction. ALL ISSUES CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND/OR ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS, SPONSOR(S) AND/OR SPONSOR ENTITIES IN CONNECTION WITH THE SWEEPSTAKES (COLLECTIVELY, “SWEEPSTAKES CLAIMS”) SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA WITHOUT GIVING ANY EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS. ENTRY INTO THE SWEEPSTAKES GIVES EACH ENTRANT’S CONSENT TO THE SOLE JURISDICTION OF THE SUPERIOR COURTS OF ORANGE COUNTY, STATE OF CALIFORNIA. All Sweepstakes Claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
