CALGARY FLAMES LIMITED PARTNERSHIP ("FLAMES")
SEASON MEMBERSHIP TERMS & CONDITIONS
By accepting the season tickets membership included in this package (the "Season Tickets"), you have expressly agreed and are hereby deemed to have agreed to abide by the following terms and conditions ("the Agreement") associated with payment for the tickets and conduct while in attendance at the Scotiabank Saddledome. If you do not agree with the following terms and conditions, you are required to immediately return your Season Tickets to the Flames and this Agreement will be terminated in accordance with Section 6 below.
Account Holder: I hereby warrant that I am the personal account holder ("Personal Account Holder") or an official representative/agent of the corporate account holder ("Corporate Account Holder"), as the case may be, and have the authority to enter into and sign binding agreements on behalf of the Corporate Account Holder.
Payment: I agree to pay to the Flames the price of my Season Tickets, including, if applicable, parking passes, Club passes, handling fees and all applicable taxes detailed on my statement in accordance with the selected payment plan ("Payment Plan").
Acceptance of Season Seat Tickets and Passes: By accepting delivery of my Season Tickets and any of the memberships and passes, I confirm my agreement to remit payment in accordance with the terms corresponding to the Payment Plan I selected. In the event that I have defaulted on my responsibility to pay for the tickets, memberships, or passes pursuant to this Agreement, in addition to any amounts outstanding, I understand that I will be responsible for re-imbursement to the Flames for the difference between the season ticket price and the game day ticket price for each game from the outset of the season through to the date of default.
Revoked Payment: In the event that any payment provided by me is returned to the Flames, or if my authorization to debit an amount from my account is revoked prior to all payments being made pursuant to this Agreement, I hereby authorize the Flames to debit the credit card or the pre-authorized bank account that I have provided for the entire outstanding amount owed to the Flames pursuant to this Agreement. I also hereby authorize the Flames to debit the credit card or pre-authorized bank account I have provided with a minimum $35.00 service charge for each dishonored payment as it occurs.
Interest Rate: The Flames may charge, and I will pay, interest at a rate of 2% per month (24% per annum) on the entire portion of my Purchase Amount that is not paid within the applicable payment terms of the Payment Plan I selected.
Termination: The Flames may, at their sole discretion, terminate this Agreement and cancel my Season Tickets, specifically any and all of my tickets, memberships and/or passes for contravention of this Agreement including for conduct in contravention of the code of conduct below. All tickets, memberships, and passes must be returned to the Flames when this Agreement is terminated.
Amendment: No amendment or modification to this Agreement shall be effective unless the same is in writing and signed by the Flames and the account holder.
Seat Transfers: I may not assign or transfer this Agreement or any of my rights hereunder, in whole or in part, without the prior written consent of the Flames, which may be unreasonably withheld. Even so, transfers can be made to a season ticket account holder's immediate family member (spouse, parent, child or sibling) OR through company name changes (due to acquisition or merger). An administration fee of $100/seat is required to process transfer requests. The Flames may assign or cancel this Agreement.
Code of Conduct: The Flames "Code of Conduct" applies to all season ticket account holders, their guests, and other fans attending home games. The "Code of Conduct" includes, but is not limited to (a) abstaining from using foul, obscene or abusive language or actions; fighting; interfering with the progress of the game, going onto the playing surface or throwing any object onto the playing surface; (b) engaging in unruly or careless behaviour; (c) having a level of intoxication that creates a disruption to the fans around you; (d) engaging in indecent exposure; (e) wearing obscene or indecent clothing; and (f) smoking. Violators will be removed from the Scotiabank Saddledome. Violations, by either an account holder or their guest(s), may also result in revocation of Season Ticket privileges.
No Waiver. No waiver or delay in enforcement of any breach or any term of this Agreement shall be construed as a waiver of that or any other term of this Agreement, and, without limitation the acceptance of any payments specified to be paid by me hereunder shall not be, nor be construed to be, a waiver of any breach of any term of this Agreement.
Severability: Each of the provisions contained herein is distinct and severable and a declaration of invalidity of unenforceability of any such provision by a court shall not affect the validity or enforceability of any other provision.
Personal Information and Privacy: I hereby grant to the Flames consent to use the personal information provided in this Agreement to provide me with the products and services I have requested, for the continued administration and maintenance of my ticket account and my on-going relationship with the Flames in accordance with the Flames Privacy Statement. A copy of the Flames Privacy Statement is available for viewing at the Flames Main Ticket Office upon request.
Use of Tickets: The Season Tickets may not be used for any commercial or trade purposes, including, but not limited to, advertising, promotions, contests or sweepstakes, without the express written consent of the Flames. Flames Season Tickets are not available for purchase when the primary, intended use of the tickets by the purchaser is commercial resale (whether through online resale platforms or other forms of distribution). The Flames may, at their sole discretion, terminate any Seasons Tickets purchased and later determined to be primarily for commercial resale purposes and will be voided by the Flames, to take effect immediately.
Ticket Rights: The ticket purchaser acknowledges and agrees that tickets being purchased hereunder are solely for NHL preseason and regular games presented by the Flames and played at the Scotiabank Saddledome, and for the avoidance of doubt, shall not include tickets, or the right to purchase tickets, to any other event or game, including, but not limited to, any NHL Global Series, NHL China Games, NHL Winter Classic, NHL Heritage Classic, NHL Stadium Series, Hockeyville, NHL All-Star or NHL Draft event (“League Special Event”) to the extent held in the Calgary market or hosted by the NHL at the Scotiabank Saddledome or otherwise in which Flames may participate. The ticket purchaser acknowledges and agrees that the Flames and/or NHL may cancel, postpone, reschedule or relocate games or events for any reason (e.g., move a regular season game of the Flames from the Scotiabank Saddledome to an alternate venue for the purposes of playing a League Special Event), as determined in its/their sole discretion, as well as to modify or discontinue, temporarily or permanently, any aspect of the rules, operations and presentations of NHL games and events (“Preemption”). In the event that any game or event for which tickets have been sold to the ticket purchaser is not played or presented in the Scotiabank Saddledome for any reason, including, but not limited to, Preemption, such event shall in no way be deemed, argued or construed to be a breach by the Flames of any terms, conditions, agreement or any other duties or obligations in connection with the sale and use of these tickets and, in such event, the ticket purchaser’s sole remedy shall be a pro-rata account credit or refund equal to the price paid for these tickets as specified in the ticket invoice, and the ticket purchaser hereby waives and releases any and all claims it may have against the Flames and/or the NHL with respect to such game(s) or event not played or presented at the Scotiabank Saddledome. The ticket holder agreement/terms and conditions that are enclosed, attached and referenced herein shall be expressly part of this invoice, incorporated herein by reference, and shall govern the transactions contemplated in this invoice, whether in hard copy, or electronic.
Flames Easy Pay:With the purchase of a season ticket, the Season Ticket Member agrees to enter into the automatic renewal process known as Flames Easy Pay. Through this process, the Season Ticket Member will have their season tickets automatically renewed for the upcoming season, until such time as they choose to opt-out of their season ticket(s) in accordance with the procedures set forth in this Agreement. The renewal notice/statement will specify any changes to the price of the season ticket(s),including, if applicable, parking passes, Club passes, and all applicable fees and taxes for the upcoming season as well as any material change to season ticket benefits. Season Ticket Members may opt out of their season ticket(s) for the upcoming season by submitting an opt out request online at https://www.nhl.com/flames/fans/stm-cancel prior to the opt out window due date.
- COVID-19: An inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. You assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting a communicable disease or illness-including, without limitation, exposure to COVID-19 or any other bacteria, virus, or other pathogen capable of causing a communicable disease or illness, whether that exposure occurs before, during, or after the event, and regardless of how caused or contracted-and you hereby waive any and all claims and potential claims relating to such risks, hazards, and dangers against Calgary Sports and Entertainment Corporation and Calgary Flames Limited Partnership, any companies affiliated with Calgary Sports and Entertainment Corporation and Calgary Flames Limited Partnership, the Event Organizer, owners, governors, officers, directors, partners, partnerships, principals, employees and agents.
