The 2023-24 NHL Fan Access™ App Sweepstakes is comprised of four (4) separate and distinct sweepstakes (collectively, the “Promotion”) which will respectively take place on location during the respective operating hours of each of the following NHL® pregame fan events (each, an “Event”): the WestJet NHL Fan Park in Edmonton, Alberta, Canada within Fan Park @ Ice District on October 27-28, 2023 (the “NHL Heritage Classic Fan Event”); the 2024 NHL Winter Classic® PreGame in Seattle, WA, on or about December 31, 2023-January 1, 2024 (the “NHL Winter Classic Fan Event”); the 2024 Hyundai NHL® Fan Fair in Toronto, Canada at the Metropolitan Toronto Convention Centre February 1-4, 2024 (the “NHL All-Star Fan Event”); and the 2024 NHL Stadium Series™ PreGame in East Rutherford, NJ at MetLife Stadium on February 17-18, 2024 (the “NHL Stadium Series Fan Event”). The Promotion is governed by these Official Rules and is subject to all applicable federal, state and local laws. Void where prohibited.

NOTE: A mobile device and download of the free 2023-2024 NHL Fan Access™ App (the “App”) are required to participate in Check-ins (as further defined below). Providing a mobile phone number associated with the downloaded App (or with postcard entry, if applicable) is required and will be used to authenticate the user for secure log-in to the App and for prize notification purposes for the respective Event, as applicable. Standard message and data charges may be incurred by using your mobile device to participate in the Promotion. Check with your wireless provider for details on any applicable charges. Entrants are solely responsible for any such wireless charges.

1. Sponsor: NHL Interactive CyberEnterprises, LLC, One Manhattan West, 395 Ninth Avenue, New York, NY 10001 (“Sponsor”).

2. Eligibility. The Promotion is open only to legal residents of the fifty (50) United States, the District of Columbia, or Canada who have reached the age of majority in their state/province/territory of legal residence at the time of entry, who have downloaded the App and registered for an NHL Fan Access™ Pass (as explained further below), and who attend and engage with the App at one (1) or more of the following Events: the NHL Heritage Classic Fan Event, the NHL Winter Classic Fan Event, the NHL All-Star Fan Event, and/or the NHL Stadium Series Fan Event (i.e. by “checking in” to various activations as further explained below) or who, alternatively (if applicable) have submitted a postcard entry in connection with an Event (any such eligible residents may be hereinafter referred to interchangeable as an “entrant” or “participant”). Employees, officers, and directors of Sponsor, the National Hockey League (“NHL”), the NHL’s member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises, B.V., NHL Network US, L.P., NHL Network US, Inc., Nortap Technology, Inc. (“Nortap” or “Patron”), Deltatre, Inc., participating partners, Oilers Entertainment Group Canada Corp., ICE District Fan Park Limited Partnership, ICE District Fan Park Corp., ICE District Arena East Development Limited Partnership, ICE District Properties (10104 – 104 Avenue) Corp., Washington State Major League Baseball Stadium Public Facilities District, Metropolitan Toronto Convention Centre Corporation, New Meadowlands Stadium Company, LLC, the New Jersey Sports and Exposition Authority, each venue (including those entities not known or designated herein as of the effective date of these Official Rules) and each of their respective parents, subsidiaries, divisions, affiliates, and advertising or promotional agencies (collectively, the “Ineligible Entities”), and the immediate family (spouse, parents, siblings and children) and household members (at least three (3) months a year, whether or not related) of each are not eligible to participate or win. In order to participate in the Promotion or receive a prize, you must fully comply with the Official Rules and, by participating, you represent and warrant that you agree to be bound by these Official Rules and the decisions of the Sponsor, whose decisions shall be binding and final in all respects relating to this Promotion.

3. Timing: Registration for the Promotion begins at 12:00 p.m. (noon) Eastern Time (“ET”) on October 1, 2023 and ends thirty (30) minutes prior to the closing time of the NHL Stadium Series Fan Event ET on February 18, 2023 (the “Registration Period”). During the Promotion, each of the four (4) distinct Events have their own respective entry periods (each, an “Entry Period” and collectively, the “Entry Periods”), which will each begin at the start of the respective operating hours for the applicable Event and end thirty (30) minutes prior to closing time each day of the applicable Event. Within each Entry Period, there will be random drawings conducted by Sponsor to award prizes to eligible participants as further set forth in Section 6 below. The Sponsor’s clock shall be the official time-keeping device for the Promotion.

4. How to participate and enter. The Promotion consists of a check-in sweepstakes program (“Sweepstakes”) that will take place within each respective Entry Period as defined above. To participate in the Sweepstakes, you must (i) first download the free NHL Fan Access™ App from either the Apple or Google Play Store onto your mobile device, and then (ii) register for an “NHL Fan Access Pass” by completing the registration form on the App as directed. During registration, you will be required to provide the mobile phone number associated with the downloaded App so that we may send you a verification code to authenticate your secure log-in to the App and so that we may notify you in the event that you have won any prize and/or to award a prize (as explained further below in Section 7). Once registration is complete, you will receive a unique Quick Response Code (“QR Code”) for you and up to five (5) accompanying minors (if applicable) and your NHL Fan Access Pass will be activated. Alternatively, if you have not downloaded the App prior to the Event, you can activate your NHL Fan Access Pass on-site at any Event by visiting the NHL Fan Access™ Pass Registration Area/Prizing Booth located by the applicable Event entrance. To enter without purchase (if applicable) and without App download and registration, you may submit one (1) postcard entry containing your first name, last name, mobile phone number, email address, country, and ZIP/postal code into the postcard entry box located at the kiosk booth near the event entrance. For clarity, if using the App to participate in the Sweepstakes, registration for an NHL Fan Access Pass is required and must take place after the App has been downloaded. During registration, you may opt to receive automated text messages pertaining to your NHL Fan Access™ Pass at the mobile phone number you provide. Note: selecting the text message option is not required to participate in this Promotion.

Once activated, each App participant’s unique QR Code (available directly through the App, saved as a photo on your phone, or printed) can later be scanned for check in (each a “Check-in”) by an NHL® Fan Access ambassador using a hand-held tablet at participating partners’ or NHL’s Check-in areas such as booths, games or activities (any such participating partner or NHL Check-in area, each an “Activation”) located throughout the respective NHL® Events. A Check-in at an Activation for the first time - i.e., the first time an eligible participant has their unique QR Code scanned (or manually inputted) by the NHL Fan Access ambassador at the applicable Activation where such ambassador is stationed – unlocks a badge at that Activation and will be recorded for the Sweepstakes. Additionally, for certain Activations where an ambassador is not stationed to scan or manually input QR Codes, “Fan Scan Posters” will be posted at such Activations, each with their own unique QR Code (such QR Code, a “Fan Scan Code”). For any Activation that has a Fan Scan Code, you may scan such Fan Scan Code using the App by taking a picture of that Fan Scan Code to Check-in at the Activation where such Fan Scan Code has been posted, and the first time you Check-in to any such Activation will also unlock a badge and be recorded for the Sweepstakes.

For clarity, while accompanying minors may check in using their respective QR Codes at Check-in areas to participate in available photo and video opportunities, games, or activities, such Check-ins made by minors will not be eligible for any entry into the Sweepstakes.

Any eligible participant who scanned their NHL Fan Access™ Pass or who scanned a Fan Scan Code, as applicable (i.e., in either case, “Checked-in”), at fifteen (15) different Activations at the respective Event or any eligible participant who, alternatively, submitted a postcard entry for any applicable Event, will be entered into all applicable drawings that take place on the Event day that the participant has either obtained the last of the fifteen (15) Check-ins required or has submitted a postcard entry for the chance to win a prize at the applicable Event. For clarity, in the case of a multi-day Event, if a participant obtains all fifteen (15) Check-ins on the first day of a respective Event or submits a postcard entry, the participant will only be eligible for any drawings that take place on the same day after such eligible fifteen (15) Check-ins have been accumulated or on the same day a postcard entry has been submitted. Thereafter, such accumulated Check-ins (or postcard entry) will not roll over into any remaining drawings occurring on any following days of that Event.

For the avoidance of doubt, if an App participant Checks-in to an Activation more than once, that only counts as one (1) Check-in for purposes of this Sweepstakes. Obtaining more than the fifteen (15) Check-ins required at any Event will not earn any additional entries.

Entries are only eligible for the respective Event in which Check-in (or postcard entry) was received and will not roll over into any subsequent Events. For clarity, as an example, any Check-ins accumulated (or postcard entries received) at the NHL Heritage Classic Fan Event will not carry over into the NHL Winter Classic Fan Event or into the NHL All-Star Fan Event or into the NHL Stadium Series Fan Event. All entries become the property of Sponsor upon receipt and will not be acknowledged or returned.

Check-ins (or postcards, as applicable) for entry into the Sweepstakes will be deemed to have been submitted by the authorized account holder of the mobile device associated with the App or with the postcard submitted. “Authorized account holder” is defined as the natural person who is assigned to a mobile phone number by a cellular service provider that is responsible for assigning mobile phone numbers for the device associated with the submitted mobile phone number. Participating or attempting to participate in the Promotion multiple times through the use of multiple accounts (or multiple postcard entries) is prohibited and any such entries will be deemed void and disqualified.

5. Sweepstakes Winner Selection; Odds of Winning. A total of one hundred and six (106) potential prize winners will be randomly selected by a Sponsor’s representative (Patron Technology) from among all eligible entries received during the Promotion as follows: nineteen (19) potential prize winners for the NHL Heritage Classic Fan Event; nineteen (19) potential prize winners for the NHL Winter Classic Fan Event; forty-seven (47) potential prize winners for the NHL All-Star Fan Event; and twenty-one (21) potential prize winners for the NHL Stadium Series Fan Event. The number of prizes available for each respective Event will vary and, therefore, so will the number of potential prize winners for each Event. Drawings will take place during operating hours of each respective Event. The prize(s) to be awarded for each random drawing will be based upon the number of Check-ins accumulated or postcard entries submitted, as applicable, and will be determined at random and revealed upon prize claim redemption. Odds of winning a prize of any kind depend upon the total number of eligible entries received during the applicable Entry Period and the total number of prizes to be awarded during such period.

6. Sweepstakes Prizes. There will be a total of one hundred and six (106) Sweepstakes prizes (each a “Prize”) available to be won at random each with a varying approximate retail value (“ARV”) as further described below. Limit one (1) Prize per person per Event.

Additional terms and conditions applicable to prizing: All other costs and expenses not expressly listed as part of any Prize, including all federal, state, provincial and local taxes and any fees are the sole responsibility of the respective winners. Transportation and hotel are not included with any NHL® game/event ticket Prize. Any Prize not accepted or unclaimed by a winner on the applicable drawing date will be forfeited and will not be substituted. In the event there are insufficient entries for any Prize level at the time of the respective Prize drawing, the respective Prize will be deemed to be unclaimed. No Prize will be replaced if lost or stolen. No Prize may be redeemed for cash. No transfer, refund, substitution or replacement of Prize permitted, except that Sponsor reserves the right, in its sole discretion, and for whatever reason, to substitute a prize of equal or greater value (or cash equivalent). ARV of Prizes is in either U.S. or Canadian dollars, as applicable. Gift cards are subject to terms and conditions. All details and other restrictions of Prizes not specified in these Official Rules will be determined by Sponsor in its sole discretion.

Resale of NHL® game/event tickets is prohibited. Winners and winners’ guests must abide by all applicable venue policies and game/event ticket terms and conditions including any rules and regulations related to COVID-19. Sponsor reserves the right to revoke the full or partial Prize from any winner or winner’s guest who Sponsor or venue personnel deem, in their sole discretion, may be intoxicated, be a safety risk, have violated any venue policy or law, or bring the Ineligible Entities into disrepute. Sponsor is not responsible if an NHL® game or event is cancelled or postponed for whatever reason.

7. Prize Notification. Upon completion of each respective Sweepstakes drawing each day of the Event, participants will be contacted by Sponsor or Sponsor’s representative (Nortap or Patron), with Sweepstakes Prize claim instructions via text messaging to the mobile phone number associated with the downloaded App or with the postcard submitted. Alternatively, a QR Code may be scanned by a Sponsor representative at the NHL Fan Access Registration/Prizing Booth to determine whether any Prize has been won, subject to verification by Sponsor. Sweepstakes winners must claim their respective Prizes on the date of the applicable drawing/prize notification by reporting to the NHL Fan Access™ Registration/Prizing Booth at the respective Event to verify eligibility and show proof of identity. Prize winners must claim their Prizes by close of business on the date of the applicable drawing/prize notification at each respective Event. Potential winners may be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release (if applicable and where permitted by law), a General Event Waiver (if applicable) and (as applicable to Canadian residents and potential winners at Events that take place in Canada) to answer unaided, a time-limited mathematical skill-testing question (collectively, the “Affidavit”), as well as complete a W9 or W8 tax form (if applicable), during the time period required by Sponsor. If applicable, winner’s guests for any game or event Prizes may also be required to complete a Liability and Publicity Release and a General Event Waiver, where permitted by law. In the event: (a) a potential winner declines the Prize or cannot accept, receive or use the Prize for any reason; (b) of noncompliance with any aforesaid time period; (c) a potential winner is found to be ineligible to enter the Promotion or receive the Prize; (d) a potential winner cannot or does not comply with the Official Rules; (e) a potential winner fails to fulfill the Affidavit-related obligations (including failing to correctly answer the skill-testing question if Canadian or if a potential winner at an Event that takes place in Canada); or (f) potential winner does not comply with COVID-19 rules and regulations, as applicable, the potential winner shall be disqualified from the Promotion and the Prize will be forfeited. Unclaimed Prizes will not be awarded.

8. Publicity Release. Except where prohibited or restricted by law, a Sweepstakes winner's acceptance of a Prize constitutes the respective winner's agreement and consent for Sponsor and any of its designees to use and/or publish winner's name (in whole or in part), winner’s guest’s name (if applicable, subject to applicable releases), city and state/province/territory of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by winner and/or winner’s guests regarding the Promotion or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, in-stadium scoreboard display, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval.

9. No Tampering; Right To Cancel; Modify. Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any Prize to participants, with regard to: (a) entries that do not comply with or violate the Official Rules; (b) entries, Prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to errors of any kind, including without limitation, computer, human or technical errors; (c) participants who have committed fraud or deception in entering or participating in the Promotion or claiming a Prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties, including in connection with the scanning of any QR Code; (e) any inability of the participant to accept the Prize for any reason; (f) a Prize that cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor's reasonable control; or (g) any damages, injuries or losses of any kind caused by any Prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any Prize or resulting from participating in this Promotion or any Promotion or Prize-related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Promotion, or with any website promoting the Promotion or in which the Promotion is administered; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Promotion multiple times through fraudulent or deceptive means, or otherwise in violation of these Official Rules. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Promotion, Sponsor reserves the right to void the Check-ins/entries at issue, and/or terminate the relevant portion of the Promotion, including the entire Promotion, and/or modify the Promotion and/or award the Prizes in the manner set forth by these Official Rules from all remaining eligible participants as of the termination time.

10. Release of Liability; Disclaimer of Warranty. By participating in the Promotion and/or accepting a Prize, participants and winners agree to release and hold harmless the Ineligible Entities, each Event sponsor and exhibitor, and each of their respective parents, subsidiaries, affiliates (past, present and future), divisions, members, partners, principals, stockholders, governors, representatives, agents, successors, assigns, employees, officers and directors (together with the Ineligible Entities, the “Released Parties”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation attorneys’ fees (collectively, “Losses”), which may occur in connection with (a) the Promotion or any element thereof, including entry or participation therein, (b) delivery, possession, acceptance and/or use or misuse of any Prize or component thereof, or (c) participation in any Promotion-related activity or Prize-related activity. In addition, by participating in this Promotion, each participant agrees to indemnify and hold harmless the Released Parties from and against any and all Losses incurred by any of the Released Parties in connection with any third-party claim, demand, liability, suit, proceeding or action arising out of or resulting from (i) breach or alleged breach of any representations, warranties or agreements of participant hereunder or under any Affidavit signed by the participant, or (ii) participant’s possession, use or misuse of any Prize or component thereof. The Released Parties assume no responsibility for any injury or damage to any participant’s or to any other person's computer or mobile device, regardless of how caused, relating to or resulting from entering or downloading materials or software in connection with this Promotion. Participants and winners acknowledge that the Released Parties have neither made nor are they in any manner responsible or liable for any warranty, representations or guarantees, express or implied, in fact or in law, relative to any Prize.

11. Disputes; Forum Selection. With regard to United States (including District of Columbia) entrants, any and all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of such entrants or Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the State of New York. In addition, any and all disputes, claims or causes of action relating to the Promotion (including these Official Rules or any Prize awarded) shall be brought in the appropriate New York state court in New York County or appropriate federal court in and for the Southern District of New York having jurisdiction over the subject matter. With regard to Canadian entrants, any and all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of such entrants and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, Canada and the laws of Canada applicable therein without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario. In addition, any and all disputes, claims and causes of action arising out of or connected with this Promotion (including these Official Rules or any Prize awarded) shall be resolved exclusively by the courts of the Province of Ontario. Applicable to all entrants, except where prohibited by law, each participant agrees that: (i) any and all such disputes, claims and causes of action shall be resolved individually, without resort to any form of class action, (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees, (iii) under no circumstances will they be permitted to obtain awards for, and hereby waives all rights to claim, indirect, punitive, incidental, consequential and/or any other damages other than actual out-of-pocket expenses, (iv) they waive any and all rights to have damages multiplied or otherwise increased, (v) they irrevocably consent to the personal jurisdiction of the aforesaid courts, as applicable to such participant, and waives any claim of forum non conveniens or lack of personal jurisdiction that they may have, and (vi) if any provision of these Official Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable, and that in any event, the unenforceability or invalidity of any provision will not affect any other provision of these Official Rules, and these Official Rules will continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as described above, as the case may be.

12. Privacy; Use of Personal Information. By participating in the Promotion, participants will be sharing their personal information with Sponsor. Any personally-identifiable information collected during an entrant's participation in the Promotion will be collected by Sponsor and used by Sponsor for purposes of the proper administration and fulfillment of the Promotion as described in these Official Rules, including sending communications in connection with such administration (e.g., to notify an entrant that they are a potential Prize winner, and/or to award a Prize). Sponsor may further use each entrant’s information collected under this Promotion as authorized in accordance with an entrant’s registration for an NHL Fan Access™ Pass and in accordance with its Privacy Policy as stated at https://www.nhl.com/info/privacy-policy or as otherwise consented to by the entrant or permitted by applicable law.

13. Winners’ List. To obtain a copy of the winners' list, send a self-addressed, stamped envelope to: NHL Fan Access™ Pass Sweepstakes, NHL Interactive CyberEnterprises, L.P., One Manhattan West, New York, New York 10001, for Sponsor's receipt by April 19, 2024. Canadian residents may omit return postage.
