Supplemental GCL Terms
In addition to the NHL.com Terms of Service (including without limitation Section 4 (Subscription Services), Section 18 (Dispute Resolution and Binding Arbitration) and Section 19 (Class Action Waiver and Jury Trial Waiver) thereof) (the “TOS”), your subscription to NHL GameCenter LIVE (“GCL”) and access to and use of the GCL service is subject to these supplemental terms (the “Supplemental Terms”). In the event of a conflict between the TOS and these Supplemental Terms, these Supplemental Terms will apply.
- For subscriptions to the website version of the GCL service (the “GCL Website Service”), our monetization partner, ViewLift, handles subscription management and payment and billing on our behalf. For this purpose, ViewLift will act as the merchant of record on our request. The services of ViewLift are subject to their Terms of Use, located at , which are hereby incorporated by reference; provided, however, that in the event of a conflict the TOS and these Supplemental Terms shall govern (and provided, further, for the avoidance of doubt, that Section 13 of the TOS (pertaining to exclusive remedy and limitation of liability) and Section 18-20 of the TOS (pertaining to dispute resolution and binding arbitration, class action waiver and jury trial waiver, and choice of law and venue, respectively) shall govern with respect to any alleged claims against the NHL (as defined in the TOS) including without limitation any “Disputes” (as defined in the TOS)). Purchases of the GCL service via the GCL mobile application (the “GCL App”) are managed by the applicable app store (e.g., Apple App Store, Google Play, etc.) (each, an “App Store”) and are subject to the applicable App Store’s terms and conditions.
- Your subscription will be charged on a monthly basis, with the first “month” beginning on the date of your subscription and each subsequent “month” beginning on the same day of such month (each, a “Subscription Month”). As an example, a subscription ordered on March 5, 2023 will have its first Subscription Month begin on March 5, 2023 and end on April 4, 2023 and its next Subscription Month begin on April 5, 2023 and end on May 4, 2023; etc. Each subscription will automatically renew each subsequent Subscription Month during the 2023-2024 NHL regular season through and including April 2024; provided, however, that the final Subscription Month will end upon the completion of the 2023-24 NHL regular season. The primary credit or debit card you have provided to ViewLift or the applicable App Store (as the case may be) to purchase your subscription will be charged on or about the same date each month of your subscription (i.e., on or about the beginning of each Subscription Month).
- GCL Website Service Cancellation and Refund Policy: You may cancel your subscription at any time. If you cancel within five (5) days of initially subscribing then your monthly subscription fee for the initial Subscription Month will be fully refunded and your subscription will be canceled. This right will be available only one time per subscriber. In addition, for subsequent Subscription Months, cancellations will be effective at the end of the Subscription Month in which you cancel and we will not refund you for any prior Subscription Months. SUBJECT TO APPLICABLE LAW, UNLESS YOU NOTIFY US IN ADVANCE OF THE BEGINNING OF THE NEXT APPLICABLE SUBSCRIPTION MONTH THAT YOU WISH TO CANCEL, YOUR SUBSCRIPTION TO THE GCL WEBSITE SERVICE WILL AUTOMATICALLY RENEW FOR SUCH SUBSCRIPTION MONTH AND YOU AUTHORIZE US (VIA VIEWLIFT OR ANY OTHER PAYMENT PROCESSING PROVIDER WE DESIGNATE) TO COLLECT THE APPLICABLE MONTHLY SUBSCRIPTION FEE AND ANY TAXES USING ANY CREDIT OR DEBIT CARD ON FILE WITH VIEWLIFT (OR WHERE APPLICABLE, SUCH OTHER PAYMENT PROCESSING PROVIDER).
- GCL App Cancellations and Refunds: You may cancel your subscription at any time, and such cancellation is subject to the cancellation and refund policies of the applicable App Store. As such, any requests for refunds must be made to the applicable App Store in accordance with its refund policies.
