NHL Connect™/ Atreyu Breaks New Ice Contest

OFFICIAL RULES

NO PURCHASE NECESSARY. CONTEST BEGINS AT 4:00:01 PM (ET) ON MARCH 10, 2008 AND ENDS AT 11:59:59 PM (ET) ON MARCH 31, 2008 (“Contest Period”).

1. HOW TO ENTER: To enter, you must be registered for the NHL ConnectTM program on or before 5:00 PM ET on March 10, 2008. Log on to the NHL ConnectTM program at http://fans.nhl.com/ during the Contest Period, then visit http://fans.nhl.com/members/Atreyu/blogs/8864 (“Contest Website”) and follow the onscreen instructions to add a new comment to answer the question “What day is Lead Sail Paper Anchor version 2.0 being released?” (the “Answer”). Entrants must be logged on to provide an Answer. Upon answering this question and clicking “Submit,” you will automatically be entered into the Contest. ENTRIES MUST BE SUBMITTED AND RECEIVED BY 11:59:59 PM (ET) ON MARCH 31, 2008. Entrant’s Answer will not impact his/her chances of winning; Winner’s Answer will be posted on the Contest Website until January 1, 2009, and all other Answers will be posted on the Contest Website throughout the Contest Period; provided, however, that Sponsor may at any time remove any Answer, in whole or in part, from the Contest Website and may void the associated entry, if at any time it deems such Answer to be defamatory, derogatory, obscene, promote hatred or intolerance, or are otherwise not in keeping with Sponsor’s image. Illegible, incomplete, damaged, forged, corrupted, or altered entries will be declared void. Limit: One entry per person. The use of automated software or computer programs to register or to enter the Contest is prohibited and any individual who uses or attempts to use such methods to register or to enter will be disqualified. All entries become the exclusive property of NHL Interactive CyberEnterprises, LLC (“Sponsor”) and its affiliates, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., the National Hockey League, and the NHL Member Clubs (collectively, “Affiliates”) and will not be returned.

2. ELIGIBILITY: Contest is open to legal residents of the United States (excluding Puerto Rico and U.S. territories and possessions) and Canada (excluding Quebec) who, as of 5:00 PM ET on March 10, 2008: (a) are of the age of majority in their state/territory/province of residence or older; (b) who are registered for the NHL ConnectTM program; and (c)who have internet access. You are not eligible if you are an employee of Sponsor, its Affiliates, and/or their respective agents, judges, licensees, franchisees, other promotion partners, retailers, distributors, advertising and promotional agencies, or a member of the immediate families (defined as parents, siblings, children and spouses, regardless of where they live) or same household, whether or not related, or such employees.

3. SELECTION OF WINNER: Entrant eligible to win (“Selected Entrant”) will be selected from all eligible entries received in a random drawing to be conducted on or about April 4, 2008 in New York, NY. If the Selected Entrant resides in Canada s/he must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered by e-mail, before being declared the official winner. Selected Entrant will be notified by e-mail. Decisions of the Sponsor are final and binding in all matters relating to this Contest. In no case will more than the stated number of prizes be awarded. The odds of winning will depend upon the number of eligible entries received.

4. PRIZE: ONE (1) PRIZE, Consisting of: one (1) Easton® Ellipse Stealth S17 Limited Edition Atreyu hockey stick (approximate retail value (“ARV”)): USD $300.00/ CAD $290.00), one (1) Edition of Iron Sails Paper Anchor on compact disc autographed by the band Atreyu (ARV: USD $15.00/ CAD $14.00). Total ARV of all prize components: USD $315.00 / CAD $304.00. (In each case, the Canadian ARV depends on current exchange rate). Prize will be awarded, assuming sufficient number of eligible entries.

Prize is not transferable and must be accepted as awarded without substitution, whether in cash or otherwise, except at Sponsor’s sole discretion. Sponsor reserves right to substitute prizes of equal or greater monetary value if the prize, or any element of the prize, cannot be awarded as described above for any reason. Sponsor is responsible only for prize delivery, and is not responsible for prize utility, quality or otherwise. Taxes (including but not limited to sales tax, income tax, customs and excise tax, and withholding taxes) and fees, if any, are the sole responsibility of prize winner.

 

5. DECLARATION OF WINNER; DELIVERY OF PRIZE: Before being declared a winner, Selected Entrant may be required to sign a declaration/affidavit of eligibility and compliance with these Contest Rules, a liability release and, to the extent permitted by law, a publicity release. Prize may be forfeited if such documentation is not returned by the deadline specified by Sponsor, or if prize notification or prize is returned as undeliverable for any reason. Prize will only be awarded to verified winner. Prize will be delivered by mail. Allow 4-6 weeks for delivery.

6. PERSONAL INFORMATION: By entering the Contest, entrants agree to the collection, use and disclosure of their personal information by Sponsor for the purposes of administering the Contest, and fulfilling the prize. Winner agrees to use of his/her name, address, likeness, voice, statements and/or prize information for promotional purposes in any medium, whether now known or hereafter developed, including but not limited to any Internet-based medium, at any time or times in perpetuity, without additional notice or compensation to the extent permitted by law. Sponsor and its affiliates may also use entrants’ personal information for other purposes to which entrants consent, whether at the time of entry or otherwise. Personal information submitted by entrants will be maintained by Sponsor and/or its Affiliates on servers in the United States, and treated in accordance with its privacy policy, available at http://www.nhl.com/nhlhq/privacy.html.

7. RELEASES; LIMITATIONS OF LIABILITY; RIGHT TO CANCEL OR TERMINATE: Sponsor and Affiliates will not be responsible for late, lost, stolen, damaged, garbled, incomplete, or misdirected entries, email, Answers, prize notifications or other communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Proof of submission does not constitute proof of receipt. Sponsor and Affiliates are not responsible for typographical errors in these Official Rules, other Contest materials and/or other written or electronic communications with entrants, or for electronic communications which are undeliverable and/or redirected from an individual’s email in-boxes a result of any form of active or passive filtering of any kind, including spam filtering, or insufficient space in entrant's e-mail account to receive e-mail messages. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Contest, and Sponsor reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsor's control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In the event of any such cancellation, termination or suspension, a notice will be posted and the winner will be selected from among all eligible entries received prior to such time. By entering this Contest, entrants agree to release Sponsor, its Affiliates, and its and their respective directors, employees, officers, and agents, including without limitation, its and their advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with (whether in whole or in part or directly or indirectly) his/her participation in the Contest. By accepting prize, winner agrees to release Sponsor, its Affiliates, and its and their respective directors, employees, officers, and agents, including without limitation, its and their advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prize or participation in any prize-related activities.

8. GENERAL: This Contest is void outside the United States and Canada, in Quebec, and where prohibited or restricted by law and subject to all applicable federal, state, provincial, municipal and local laws and regulations. This Contest will be governed by the internal laws of the State of New York. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the City, County and State of New York and the courts with appellate jurisdiction therefrom. Sponsor reserves the right, at its sole discretion, to disqualify any entrant from this Contest or any other promotion conducted now or in the future by Sponsor or any of its Affiliates if his or her fraud or misconduct affects the integrity of the Contest. By participating in this Contest, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of Sponsor and/or Contest judges, and warrants that s/he is eligible to participate in this Contest. Paragraph headings are for convenient reference only and are not to affect the interpretation of these Official Rules. No correspondence will be entered into except with potential winner(s) or otherwise in compliance with paragraphs 6 and 10 of these Official Rules. If any provision of these Official Rules is declared invalid or unenforceable, such provision shall be deemed modified to the extent necessary and possible to render it valid and enforceable. In any event, the unenforceability or invalidity of any provision shall not affect any other provision of these Official Rules, and these Official Rules shall continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as above provided, as the case may be.

9. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

10. WINNER’S NAME: If U.S. residents wish to obtain name of winner, they may send a self-addressed, stamped envelope to: Community Manager, 1185 Avenue of the Americas, New York, NY 10036. Requests must be received by May 1, 2008. Winner’s name will be sent after declaration of winner.
