2024.25 Season Ticket Holder Handbook

The 2024.25 Pittsburgh Penguins Ticket Holder Handbook ("Handbook" or "Agreement") consists of Terms and Conditions as well as Resources and the Game Code of Conduct. Please review this Handbook in its entirety before purchasing season tickets. By purchasing season tickets, you are agreeing to comply with this Handbook.

PITTSBURGH PENGUINS

SEASON TICKET AGREEMENT

THIS AGREEMENT CONTAINS AN AUTOMATIC RENEWAL FEATURE. IF YOU ENROLL IN A SEASON TICKET PLAN (AS DEFINED BELOW), YOU WILL BE CHARGED, AND PAYMENTS WILL CONTINUE TO BE PROCESSED, FOR SEASON TICKETS ANNUALLY UNTIL YOU OPT-OUT. YOU WILL BE OFFERED THE OPPORTUNITY TO OPT-OUT ANNUALLY DURING AN OPT-OUT WINDOW WHICH WILL BE SPECIFIED ON THE APPLICABLE SEASON'S INVOICE SENT TO YOU PRIOR TO THE START OF EACH SEASON. FOR THE AVOIDANCE OF DOUBT, YOUR SEASON TICKET PLAN WILL AUTOMATICALLY RENEW FOR THE 2025.26 SEASON UNLESS YOU OPT-OUT DURING THE OPT-OUT WINDOW. THIS AGREEMENT INCLUDES AN ARBITRATION PROVISION WITH A CLASS ACTION AND JURY TRIAL WAIVER. THE ARBITRATION PROVISION MAY HAVE A SUBSTANTIAL IMPACT ON THE WAY IN WHICH YOU OR THE PENGUINS RESOLVE ANY CLAIM.

SEASON TICKET AND AUTOMATIC RENEWAL TERMS AND CONDITIONS

BY SUBMITTING AN ORDER AND TENDERING PAYMENT TO THE PENGUINS AND/OR ACCEPTING ANY TICKET(S) PROVIDED BY THE PENGUINS ACCORDING TO THE ORDER OR ACCOUNT ESTABLISHED BY ACCOUNT HOLDER, ACCOUNT HOLDER SIGNIFIES ACCEPTANCE OF AND AGREEMENT TO BE BOUND BY THESE TERMS AND CONDITIONS.

These Season Ticket and Automatic Renewal Terms and Conditions (the "Terms and Conditions") governs the purchase of Pittsburgh Penguins season tickets and/or multi-game ticket packages (individually, a "Ticket" and collectively, the "Tickets") during the 2024.25 NHL preseason and regular season, and for any subsequent seasons, for which you do not opt-out. The Terms and Conditions are by and between the purchaser named on the season ticket holder Account (the "Account Holder," "you" or "your") and the Pittsburgh Penguins LP (the "Penguins," "we," "our" or "us"). In consideration of the following promises and mutual covenants, the sufficiency whereof is hereby acknowledged, the parties agree as follows:

1. TICKETS

The Pittsburgh Penguins season ticket holder ("Account Holder", "Holder" "you" or "your") acknowledges and agrees that the purchase of Tickets are solely for 2024.25 NHL preseason and regular season Games presented by the Pittsburgh Penguins and played at PPG Paints Arena, and for the avoidance of doubt, shall not include tickets, or the right to purchase tickets, to any other event or game, including, but not limited to, any NHL European Global Series Games, NHL China Games, NHL Winter Classic, NHL Heritage Classic, NHL Stadium Series, NHL All-Star or NHL Draft event ("League Special Event") to the extent held in the Pittsburgh market or hosted by the NHL at PPG Paints Arena or otherwise in which the Pittsburgh Penguins may participate.

The Account Holder acknowledges and agrees that the Pittsburgh Penguins and/or NHL may cancel, postpone, reschedule or relocate games or events for any reason (e.g., move a regular season game of the Pittsburgh Penguins from PPG Paints Arena to an alternate venue for the purposes of playing a League Special Event), as determined in its/their sole discretion, as well as to modify or discontinue, temporarily or permanently, any aspect of the rules, operations and presentations of NHL games and events ("Preemption"). In the event that any game or event for which Tickets have been sold to the Account Holder is not played or presented in PPG Paints Arena for any reason, including, but not limited to, Preemption, such event shall in no way be deemed, argued or construed to be a breach by the Pittsburgh Penguins of any terms, conditions, agreement or any other duties or obligations in connection with the sale and use of these Tickets and, in such event, the Account Holder's sole remedy shall be a pro-rata account credit or refund equal to the price paid for these Tickets as specified in the Ticket invoice, and the Account Holder hereby waives and releases any and all claims it may have against the Pittsburgh Penguins and/or the NHL with respect to such game(s) or event not played or presented at PPG Paints Arena.

Each Ticket represents a limited, revocable license to attend the Game listed on the applicable Ticket. We may set a limit on how many Tickets an Account Holder may purchase in our sole discretion. Tickets may be revoked, and admission may be refused, at any time for any reason upon a pro-rata account credit or refund equal to the price paid for the Ticket. Notwithstanding the foregoing, the Penguins reserve the right, without any refund paid, to refuse admission to, or eject any person whose conduct is deemed to be disorderly or otherwise fails to comply with these Terms and Conditions. Use of the Tickets is subject to the (i) terms and conditions set forth on the Tickets themselves, (ii) the Venue Rules (as defined below), (iii) NHL policies ("NHL Policies"), (iv) the Game Code of Conduct and (v) applicable law.

SEASON TICKET AUTOMATIC RENEWAL AND PLAYOFF PRIORITY You have elected to purchase Tickets to either (1) each and every preseason and regular season game during the 2024.25 season (a "Full Season Ticket Plan") or (2) a specified number of preseason and regular season games for the 2024.25 season not amounting to the whole season (a "Half Season Ticket Plan") (each such plan a "Season Ticket Plan").

This Agreement governs the terms of your Ticket purchase regardless of the manner in which you have agreed to purchase the Tickets. This Agreement will automatically renew for subsequent seasons unless you opt-out.

Season Ticket Plans will renew automatically for subsequent preseason and regular season games. Before the beginning of any subsequent season (typically in the first quarter of the year), we will send a notification to your primary email address on file linking to your online invoice and detailing the automatic renewal opt-out date, the cost of the upcoming season's Season Ticket Plan and the start date of the recurring installments. The Penguins will provide Account Holder with at least thirty (30) days' notice of the beginning of the opt-out window and such notice shall not be more than sixty (60) days prior to the beginning of the opt-out window. You agree to promptly notify us of any updated address and/or email address that should be used to contact you. The invoice may include terms that differ from the terms and conditions set forth in a previous Season Ticket Plan including, without limitation, different seat locations, different per-seat prices, the payment of a deposit or terms that are in addition to or different from the terms and conditions of any previous Season Ticket Plan. By choosing to not opt-out in the manner set forth in the applicable invoice, you agree to be bound by such terms. If you do not wish to purchase Tickets for the upcoming season under the terms set forth in the invoice, you may opt-out of the automatic renewal at any time during the opt-out period by mailing written notification (including your account number and daytime telephone number) to the Penguins at 1001 Fifth Avenue, Pittsburgh, PA 15219 (Attn: Box Office), emailing the Penguins at [email protected] or in any other manner set forth in the invoice. The opt-out period will be set forth in the invoice. If you do not opt-out of the automatically-renewing Season Ticket Plan before the end of the opt-out period, you agree to purchase the Tickets that comprise of the Season Ticket Plan under the terms of this Agreement and any applicable invoice by making the payments specified in the invoice in accordance with the Payment Authorization. Except as set forth above, you may not cancel or opt-out of the automatically renewing Season Ticket Plan.

We reserve the right to terminate or modify the automatic renewal of Season Ticket Plans at any time, for any reason and without recourse. For the avoidance of doubt, nothing in the Tickets, the Season Ticket Plan, or this Agreement should be construed to create a right on the part of any Season Ticket Holder to renew a Season Ticket Plan or to purchase Tickets to seasons, games or events subsequent to the 2024.25 season. Without waiver of the foregoing, except with respect to those Season Ticket Holders whose Tickets are to accessible seats but who do not require accessible seating and/or those Season Ticket Holders whose Tickets are to seats in area(s) of PPG Paints Arena which have been reconfigured and therefore no longer exist in the same form, it is the Penguins' standard policy to offer those Season Ticket Holders who have Season Ticket Plans and who are in compliance with the terms and conditions of this Agreement and any applicable Invoice, the opportunity to purchase Season Ticket Plans for the following season provided that the Penguins have available inventory. Any such purchase will be solely on the terms offered, which may include a different seat location, different per-seat prices, the payment of a deposit, different Games (with respect to Half Season Ticket Plan Holders), or terms that are in addition to or different from the terms and conditions of this Agreement or any applicable invoice.

It is the Pittsburgh Penguins' standard policy to offer Holders, who are compliant with this Handbook, the opportunity to purchase the corresponding Ticket plan for the playoffs and the following season. Season ticket sales in the future seasons are subject to any changes, modifications, limitations, and/or deadlines that the Pittsburgh Penguins may adopt in their sole discretion (including, without limitation, price increases).

2. ACCOUNT

Ticket Statement. After submitting an order or establishing a Ticket account (an "Account") with the Penguins, the Account Holder will receive an invoice or written confirmation from the Penguins confirming the number of Tickets that the Account Holder will receive, the Game(s) for which the Holder will receive Tickets, any other benefits purchased by the Account Holder, and a statement of amounts due from the Account Holder (the "Statement").

Account Holder. Account Holder must be an individual living adult or legal business entity. The ticket holder is the person who actually uses the Ticket to rightfully enter the Venue for the Game ("Ticket Holder"). The Account is the online account designated by the Penguins for the Account Holder to use to manage the Tickets, payments, and other rights and obligations of the Account Holder. The Account Holder of record is listed on the Account as the primary contact. Account Holders are encouraged to keep an active email address on file with the Penguins. Email is often the first method of contact for reaching Account Holders about invoice reminders, Game time changes, season ticket holder-only contests and promotions, surveys and special invitations. Penguins' fans who purchase Tickets through NHL Ticket Exchange receive a mobile Ticket with a new, unique barcode identifying the buyer as the new owner of that Ticket.

Account Changes. Changes to the name of the Account Holder must be submitted to the Penguins in writing and bear the signature of the Account Holder. All requests for name changes should be sent to: Pittsburgh Penguins Customer Service Department, PPG Paints Arena, 1001 Fifth Ave., Pittsburgh, PA 15219, Fax: 412.255.1983. Address or other information changes must be sent to the Pittsburgh Penguins via the Account Holder's e-mail address of record to [email protected]. A fee may be assessed for Account transfers or changes. Only the Account Holder named on the Statement may conduct transactions involving the Tickets. The Penguins retain the exclusive right to settle, in their sole discretion, any and all disputes concerning the ownership of an Account or disputes as to who is the Account Holder.

3. ACCOUNT HOLDER RIGHTS

a. Right to Purchase Other and Future Tickets. Account Holders who are in compliance with these Terms and Conditions will have a right of first refusal to purchase tickets (in the same seat location as Tickets for the current regular season) for any NHL Playoff games in which the Penguins compete, if any, that take place at the Venue during the current season for which Account Holder holds Tickets. Season ticket sales for future seasons are subject to any changes, modifications, limitations, and/or deadlines that the Penguins may adopt in their sole discretion (including, without limitation, price increases). The Penguins reserve the right to refuse to sell future season tickets to any individual or entity that fails to comply with these Terms and Conditions or the Handbook. The Penguins or the Venue may, in their sole discretion, offer Account Holders the ability to purchase special priced tickets for other games or events at the Venue. See the Non-Hockey Events section of the Resources for more information.

b. Donation, Transfer and Resale of Tickets. Except as otherwise authorized in these Terms and Conditions, the Account Holder has no right to transfer Tickets to any person or entity. Any attempt to sell or otherwise transfer Tickets or the associated Account Holder privileges will not be recognized by the Penguins and may result in cancellation of the Tickets and all Account Holder privileges. The resale of a Ticket at a premium is prohibited by law. Tickets obtained from sources other than the Penguins, its authorized agents or the arena box office may be lost, stolen or invalid and may not be honored. Tickets may be donated, transferred or sold through the following outlets only:

i. Transfers. Account Holders may transfer Tickets to friends and family via their online Account. To get started, the Account Holders must log onto Account Manager and select the game. When transferring Tickets, please note the following:

  1. You must know the recipient's email address or mobile phone number.
  2. After the invitation is sent, the recipient must build an Account Manager account to accept the Tickets.
  3. Once a Ticket is accepted or stored, the original Ticket is voided.
  4. At any time, the new Ticket Holder is able to log back into Account Manager and view a mobile version of the Ticket. This mobile Ticket can be used for entry at all gates at PPG Paints Arena.

ii. Donation. Account Holders may donate Tickets to Tickets for Kids Charities which will use the Tickets to provide children in the Pittsburgh community the special opportunity to attend Penguins home games at the Venue. Tickets must be donated at least [72] business hours prior to the Game date. This provides Tickets for Kids Charities sufficient time to find a deserving child and chaperone. To donate, please visit My Penguins Account or call the Penguins Customer Service Department at 412.642.1842 (tel:+14126421842). Unfortunately, single seat donations cannot be accepted. To learn more about Tickets for Kids Charities and the community groups it partners with, please visit the Tickets for Kids Charities' website.

With Account Manager, you can:

  • Transfer tickets via email to friends, family or clients
  • Donate your tickets to Tickets for Kids Charities up to [72] business hours before the game date (deadline may vary by game).
  • Post tickets for sale with NHL Ticket Exchange
  • Pay invoices & enroll in the interest free payment plan
  • Download mobile tickets to your smartphone at no charge

III. Resale. Account Holders can visit the NHL Ticket Exchange section of their Account and post their Tickets for sale to other fans. The transaction is entirely automated and processed by Ticketmaster. Penguins' fans who purchase Tickets through NHL TicketExchange receive a mobile Ticket with a new, unique barcode identifying the buyer as the new owner of that Ticket. If your posted Tickets are sold through NHL Ticket Exchange, you have the opportunity to select direct deposit to a bank account or a credit to your Account that may be applied to individual game purchases, playoff payments, or your season ticket Statement. Your use of NHL Ticket Exchange is governed by the NHL Ticket Exchange terms and conditions. To authorize the Penguins to apply your resale credit to a specific game or plan, please contact the Customer Service Department at 412.642.1842 during normal business hours or e-mail [email protected]. THE PENGUINS HAVE A ZERO TOLERANCE POLICY FOR DECEPTIVE OR FRAUDULENT TICKET RESALE ACTIVITY. The Penguins may revoke all remaining Tickets, without refund, from any Account that the Penguins' believe, for any reason, has been involved in or used to engage in deceptive or fraudulent activity. Nothing in these Terms and Conditions prohibit Account Holder from reselling tickets, provided that all Account Holders and Ticket purchasers must comply with the terms and conditions governing use and resale of the Tickets, including these Terms and Conditions and all applicable laws, at all times.

IV. Promotional Use of Tickets. Unless expressly agreed by the Penguins in writing, the Tickets may not be used for advertising, promotions (including contests and sweepstakes), or other trade or commercial purposes.

4. LIMITATIONS AND CONDITIONS TO USE

a. Mobile Ticketing. The Penguins reserve the right to automatically enroll Account Holders in the Mobile Ticketing Program. See the Mobile Ticketing Section of the Handbook for additional details.

b. Cancellation, Modification or Termination of Games. Account Holders and Ticket Holders acknowledge and agree that the Penguins and/or NHL may cancel, postpone, reschedule or relocate games for any reason (e.g., move a regular season game of the Pittsburgh Penguins from the Venue to an alternate venue for the purposes of playing a League Special Event), as determined in its/their sole discretion, as well as to modify or discontinue, temporarily or permanently, any aspect of the rules, operations and presentations of NHL games and events ("Preemption"). Game opponents, dates and times are subject to change without notice.

c. Venue Rules. Account Holder and Ticket Holders will be bound by all terms and conditions upon which tickets for admission to the Venue are issued and will observe at all times the rules, regulations, policies and limitations related to admission, behavior and use of the Venue, as determined on an on-going basis, and all applicable laws, statutes, rules, regulations, decisions and orders of any applicable federal, state or local governments, administrative agencies and commissions ("Venue Rules"). The Penguins and the Venue reserve the right to refuse admission, eject, and/or or revoke the right to enter or remain in the Venue, without refund, for anyone failing to comply with the Venue Rules, Game Code of Conduct or engaging in any misconduct, as determined by the Penguins and/or Venue in their sole discretion. Bottles, cans, flasks, alcoholic beverages, laptops, backpacks, bags larger than 4" x 6" x 1.5", and cameras with a detachable lens longer than three inches are prohibited inside this facility. Violators will be ejected from the premises.

d. Personal Property. The Penguins and the Venue are not responsible for loss of personal property brought into the Venue.

e. Parking Passes. The Penguins may, in its sole discretion, offer Account Holder the opportunity to purchase passes for parking in Venue-controlled lots on terms and in locations determined by the Venue. See the Resources section of the Handbook for more details on parking.

f. Searches. Ticket Holders consent to searches by the Penguins, the Venue, or their designated agents of all persons, bags, clothing and other articles prior to entry into the Venue. The Penguins reserve the right to require removal of items the Penguins deem, in its sole discretion, to be potentially dangerous, inflammatory or inappropriate.

g. Recording and Broadcast Rights. The NHL, the Penguins and their respective broadcast partners are the sole holders of all rights in and to all television, radio, internet or any other broadcast of the Penguins games. Account Holder and Ticket Holders may not use any broadcast or make any video or audio recording of any Penguins game for commercial purposes.

h. Accessible Seating and Parking. Accessible seating is located throughout the Venue's lower and upper concourses. Wheelchair accessible seats in the Giant Eagle | Snapple (200) Level may be reached by elevators. Account Holders may request accessible or limited mobility tickets for individual games by calling the Penguins Customer Service Department at 412.642.1842. Accessible ticket purchases and exchanges are first-come, first-served. Should special seating be needed, advance notice is encouraged. Accessible parking spaces are located in the Venue's East and South parking lots. You must have a valid handicap person placard to park. Accessible parking is first-come, first-served and spaces are limited. An early arrival is strongly recommended.

5. COSTS AND PAYMENT

a. Ticket Cost. All Ticket payments are due by the date indicated on the Statement. A third party may make payments on a Ticket account that has been established in the name of another individual or entity. Such payment, however, does not establish any right to the Tickets, Account, associated Tickets, or benefits.

b. Method of Payment. In the event that you elect to pay for your Tickets in multiple installments, you authorize the Pittsburgh Penguins to charge the credit card on file, or any substitute credit card you later provide, for each installment on or after the date it is due.

c. Deposit. We may require Account Holders to submit a non-refundable deposit, as determined in the Penguin's sole discretion, to establish the Account and/or reserve the Tickets.

d. Late Payment. If your Account is not paid in accordance with the payment schedule set forth on your Statement, then the barcodes on the original Tickets may be deactivated, in our sole discretion. To reactivate barcodes, payment is required. We reserve the right to charge a late fee in an amount up to the highest charge allowed by applicable law for the outstanding or late payment of any amount due by Account Holder. Should an Account fall multiple installments behind, the Penguins reserve the right to accelerate payments or require immediate payment of the entire unpaid balance. Nonpayment may result in the cancellation of your Ticket plan and its associated benefits. Ticket cancellation will not release an Account Holder from the Account Holder's obligation to pay all amounts due. If an Account Holder makes check payments, the Penguins reserve the right to assess a $25 fee if the check is returned due to insufficient funds.

6. TERM The Term of these Terms and Conditions is for a one-season term and will expire at the conclusion of the season for which Tickets are provided, unless terminated earlier in accordance with these Terms and Conditions. Neither party has the right or obligation to renew these Terms and Conditions.

7. RISKS AND LIMITATION OF LIABILITY

a. Lost Tickets. The Penguins are not responsible for lost, stolen, misplaced or forgotten Tickets. The Penguins shall not be obligated to admit a Ticket Holder to a Game unless a valid Ticket is presented. We may, in our sole discretion, issue replacement tickets for lost or stolen Tickets, but are under no obligation to do so. If your Tickets are lost, destroyed or inaccessible and you need a replacement Ticket issued, please call the Penguins Customer Service Department at 412.642.1842 or visit the Penguins Ticketing Department at the Venue. Only the Account Holder of record can request a replacement Ticket. Please note: this service is to be used on an emergency-only basis. It should not and will not be used as an alternative to viewing and forwarding mobile tickets via Account Manager. If the Penguins replace a Ticket, such replacement will be honored over the original, and the original Ticket will be null and void. Individual Game tickets purchased online through Ticketmaster cannot be reprinted by the Penguins Ticketing Department. Purchasers must contact Ticketmaster directly.

b. Refunds. ALL TICKET SALES ARE FINAL. Unless specifically provided in this section, there will be NO CREDITS, EXCHANGES OR REFUNDS PROVIDED FOR TICKETS ONCE ORDERED. Deposits may be refunded in the sole discretion of the Penguins. Tickets will not be refunded for any Game held on the date scheduled. In the rare event of a cancellation or postponement of a Game, the Penguins will announce applicable policies and procedures at that time. To request a refund for unused playoff credit (following the final home playoff game) or Account credit (after the current season is paid in full), the Account Holder must make the request in writing. Refunds issued by the Penguins at any time will be in the same manner in which the original payment was made (e.g., refunds from credit card purchases will be credited to the same credit card). Refunds if made will be processed within 30 business days of receipt of the request.

c. Assumption of Risk and Grant of Rights. DESPITE ENHANCED SPECTATOR SHIELDING MEASURES, PUCKS STILL MAY FLY INTO THE SPECTATOR AREA. SERIOUS INJURY CAN OCCUR. STAY ALERT AT ALL TIMES INCLUDING DURING WARMUP AND AFTER THE PLAY STOPS. IF STRUCK, IMMEDIATELY ASK AN USHER FOR DIRECTIONS TO A MEDICAL STATION. THE TICKET HOLDER ASSUMES ALL RISK AND DANGER OF PERSONAL INJURY AND ALL OTHER HAZARDS ARISING FROM OR RELATED IN ANY WAY TO THE GAME FOR WHICH THE TICKET WAS ISSUED, WHETHER OCCURRING PRIOR TO, DURING, OR AFTER THE GAME, INCLUDING SPECIFICALLY (BUT NOT EXCLUSIVELY) THE DANGER OF BEING INJURED BY HOCKEY PUCKS AND STICKS, OTHER SPECTATORS OR PLAYERS, OR BY THROWN OBJECTS. The Ticker Holder agrees that the Venue, NHL, its officers and employees, the participating clubs, their officers, players, employees and agents are expressly released by the Ticket Holder, to the fullest extent permitted by law, from claims arising from any such causes. By use of the Ticket, the Ticket Holder (i) agrees not to transmit or aid in transmitting any description, account, picture, video, audio or reproduction of the Game for which the Ticket is issued, and (ii) grants permission to the NHL, the Penguins, the other NHL teams and their respective agents to utilize the Ticket Holder's name, image, voice and/or likeness in any recorded audio, video or photographic display or other transmission or reproduction of a Game in which the Ticket Holder attends, in whole or in part, without notification to the Ticket Holder or compensation of any kind.

d. Non-Occurrence of Game. In the event that any Game, for which Tickets have been sold to the Ticket Holder, is not played in the Venue for any reason, including, but not limited to, Preemption, then the failure of such Game to be played shall in no way be deemed, argued or construed to be a breach by the Pittsburgh Penguins of any terms, conditions, agreement or any other duties or obligations in connection with the sale and use of the Tickets and, in such event, the Ticket Holder's sole remedy shall be a pro-rata account credit or refund equal to the price paid for these Tickets (i.e., the Tickets for the Game(s) not played) as specified in the Statement, and the Ticket Holder hereby waives and releases any and all claims it may have against the Penguins and/or the NHL with respect to such Game(s) not played at the Venue.

8. ADDITIONAL TERMS

a. NHL Rules. These Terms and Conditions shall in all respects be subject to and subordinate to each of the following, as such may be amended from time to time: (a) the NHL Constitution; (b) the NHL By-laws; (c) all other rules, regulations and policies of the NHL and the resolutions of its Board of Governors; (d) any collective bargaining agreement between the NHL and/or its member clubs and other parties; (e) all consent decrees and settlement agreements entered into, between or among the NHL and its member clubs or the NHL, NHL member clubs and/or other persons in furtherance of NHL business or interests or as otherwise authorized directly or indirectly by the NHL Board of Governors, the NHL Commissioner, or the NHL Constitution; (f) any television or cable, radio, or other media network agreements between the NHL and third parties; and (g) any national corporate marketing, licensing, sponsorship or similar agreements between the NHL (or NHL affiliates) and third parties, all as the same may now exist or hereafter be amended or enacted or as they may be interpreted by the Commissioner of the NHL.

b. Ticketmaster. These Terms and Conditions are also subject to the Ticketmaster terms available at http://www.ticketmaster.com/h/terms.html.

c. Jurisdiction and Mandatory Arbitration. This Agreement and its terms and conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflicts of law principles. In consideration for being allowed to purchase a Season Ticket Plan, Account Holder agrees that ALL DISPUTES, CLAIMS OR CONTROVERSIES ARISING OUT OF OR RELATING TO THE PURCHASE, SALE OR USE OF PENGUINS TICKETS OR ATTENDANCE AT PENGUINS GAMES SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION before a single arbitrator appointed by the American Arbitration Association ("AAA") in accordance with its then governing rules and procedures, including the Supplementary Procedures for Consumer-Related Disputes, where applicable. Account Holder and the Penguins WAIVE ALL RIGHTS TO A TRIAL BY JURY in any action or proceeding involving any claim. The arbitration shall be held in Allegheny County, Pennsylvania, and judgment on the award rendered by the arbitrator may be entered by any court of competent jurisdiction. Account Holder and the Penguins agree that the arbitrator shall have authority to award legal and equitable relief available in the courts of the Commonwealth of Pennsylvania, provided that: (1) the arbitrator shall not have authority to award consequential damages (regardless of foreseeability) or punitive damages; and (2) any and all claims shall be arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a claim of any other party. This arbitration undertaking is made pursuant to and in connection with a transaction involving interstate commerce, and shall be governed by and construed and interpreted in accordance with the Federal Arbitration Act.

d. Severability. If any provision of these Terms and Conditions is determined to be invalid, illegal or unenforceable, then such provision shall be deemed to be ineffective to the extent of such invalidity, illegality or unenforceability without invalidating or rendering unenforceable the remaining provisions of these Terms and Conditions.

e. Notices. Notices and requests from the Penguins are communicated to Account Holders via several methods, independent of and/or in combination with each other, including, but not limited to, the United States Postal Service, telephone, fax, or email. It is the Account Holder's sole responsibility to maintain accurate, current, and complete contact information on their Account. Any written notices to the Penguins should be made to: Pittsburgh Penguins Customer Service Department, PPG Paints Arena, 1001 Fifth Ave., Pittsburgh, PA 15219, Fax: 412.255.1983.

f. Amendments and Reservation of Rights. The Penguins may amend or supplement these Terms and Conditions as it deems necessary on an on-going basis. Amendments, revisions and/or information about the Account terms and these Terms and Conditions may be sent to Account Holder or posted on the Penguins website from time to time. Account Holder is responsible for reading and complying with all information, revisions and amendments. Enforcement of these Terms and Conditions shall be at the Penguins' sole discretion and the Penguins reserve the right to take whatever action the Penguins' deem necessary depending upon the circumstance or situation. The Penguins reserve the right to change your seat location at any time.

g. Assignment. Except as expressly provided in these Terms and Conditions, Account Holder may not assign or transfer any of its rights or obligations under this Agreement without the express written consent of the Penguins which may be withheld for any or no reason. In the event of any attempt by Account Holder to offer, sell, assign or transfer its Tickets or other rights under these Terms and Conditions in violation of these Terms and Conditions, the Penguins shall have the right, but not the obligation, to terminate these Terms and Conditions and the Account Holder's Account and Tickets.

h. Entire Agreement. These Terms and Conditions constitute and contain the entire agreement and understanding between the parties with respect to the subject matter hereof.

With the increased focus on secure, contactless entry, PPG Paints Arena is now a mobile-only facility. Fans, including season ticket holders, will be required to show a mobile ticket via a smartphone to gain entry. Fans can access their tickets by visiting www.pittsburghpenguins.com/myaccount or by clicking 'Manage My Tickets' from the Tickets menu in the Penguins App. If tickets were purchased through ticketmster.com the Ticketmaster App is recommended.

IMPORTANT: Screenshots of barcodes and 8 ½ x 11 PDF tickets will not be accepted at any PPG Paints Arena event.

Reserved Parking

Reserved parking is available for purchase to full season Ticket Holders only. Due to the high demand, a reserved parking waiting list was introduced prior to the start of the 2007.08 season. Dairy Queen Birthday or Anniversary Requests

By making a monetary donation to the Pittsburgh Penguins Foundation, you can surprise someone with a birthday or anniversary greeting at any Penguins home game. A public address announcement will alert guests of the beginning of the display. To have someone's name displayed, please visit pittsburghpenguins.com for details. All requests must be placed at least 48 hours prior to the selected game.

Game Code of Conduct

The following sets forth the code of conduct by which all Ticket Holders must comply.

Fan Behavior

PPG Paints Arena intends to provide a safe, comfortable, and fan-friendly atmosphere for all of our guests. Consequently, the Pittsburgh Penguins strictly prohibit and will not tolerate certain behavior, including, but not limited to, the following, which may be cause for ejection, loss of season ticket privileges, and/or arrest and prosecution:

  1. unruly, offensive, inappropriate, or hostile behavior that interferes with the ability of others to enjoy the event;
  2. foul or abusive language or gestures;
  3. the appearance of intoxication;
  4. behavior interfering with the progress of the event;
  5. behavior causing property damage;
  6. any attempt to gain, provide, or permit unauthorized admission on cancelled tickets, de-activated tickets, or otherwise, or engagement in any other fraudulent activity or scheme with respect to tickets, admissions, or any good or service made available at the PPG Paints Arena; and
  7. any other violation of the rules, policies, or directives of the Pittsburgh Penguins, the PPG Paints Arena and their management.

Patrons may be ejected without warning if deemed necessary for the safety of other individuals. Repeated instances of unacceptable behavior by you or other patrons using your tickets shall be grounds for revocation of a season ticket plan.

Hockey Etiquette

As a show of hockey etiquette, and as a courtesy to others, we ask that you wait until there is a stoppage of play before leaving or returning to your seat. Also, please refrain from leaning forward, as it may obstruct the view of others seated behind you.

For the comfort and safety of your fellow fans, please keep aisles clear. Standing behind the last row of seats is prohibited unless designated by a Standing Room Only ticket.

Official NHL Fan Code of Conduct Policy

The National Hockey League and its Member Clubs are committed to creating a safe and comfortable environment and enjoyable entertainment experience. NHL fans have a right to expect an environment in which they will be treated in a consistent, professional and courteous manner by all arena, team and National Hockey League personnel. The Players and Officials have the same rights. Accordingly, fans are responsible for their own conduct.

The following standards have been established with respect to fan conduct:

  • Fans are entitled to enjoy the hockey experience free from disruptive or inconsiderate behaviors or unruly actions.
  • Fans may not interfere with the event and/or athletes in any manner.
  • Fans shall refrain from using abusive language or obscene gestures.
  • Fans may not engage in fighting, throwing objects or other behavior deemed detrimental to the experience of other guests and those who engage in any of these actions will immediately be ejected from the game.
  • Fans are encouraged to report inappropriate behavior to arena staff.
  • Fans who choose to consume alcohol must do so in a legal and responsible manner. Intervention with an intoxicated or impaired fan will be handled in a prompt and safe manner.
  • Fans shall comply with requests from arena staff regarding arena operational and emergency procedures.
  • Fans may not engage in unauthorized commercial activity while on arena property.

Violation of the Fan Code of Conduct may result in eviction from the arena without a ticket refund. The NHL and its Member Clubs thank you for adhering to the provisions of the NHL Fan Code of Conduct.
